PLACED ON SECOND <br />READING MARCH 6, 2000. <br /> <br />Lakewood. <br /> <br />ORDINANCE NO22-OOB: BY: Corrigan, FitzGerald, Georg <br /> Roth, Seelie, Skindell, Smith. <br /> <br />AN ORDINANCE to amend the Building Code of the Codified Ordinances of the City of <br /> <br /> WHEREAS, the City has initiated and implemented a number of programs in an <br />attempt to upgrade and improve the residential and commercial properties in the City; and <br /> <br /> WHEREAS, Article XV, Section 3 of the Lakewood City Charter empowers the <br />Planning Commission to "...make plans and proposals for specific improvements and projects which <br />it deems desirable for the City...and to have such other powers and functions as may be imposed <br />by City Council by ordinance or resolution"; and <br /> <br /> WHEREAS, on February 16, 2000 the Planning Commission has adopted design <br />guidelines for use by the Architectural Board of Review, and recommends the periodic review and <br />amendment of such guidelines and addition of new guidelines as necessary; and <br /> <br /> WHEREAS, the guidelines promote the development of and protect exisUng residential <br />uses found throughout the City thereby protecting property values; and <br /> <br /> WHEREAS, such guidelines encourage the orderly development and retention of <br />commercial uses in a manner consistent with the Community Vision; and <br /> <br /> WHEREAS, through such guidelines the Architectural Board of Review can accomplish <br />its purposes which are to protect the value, appearance and use of property on which buildings <br />are constructed or altered, to maintain a high character of community development, to protect the <br />public health, safety, convenience and welfare and to protect real estate within the City from <br />impairment or destruction of value; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That existing Section 1325.03 of the Codified Ordinances of the City of <br />Lakewood, which now reads as follows: <br /> <br />Section 1325.03 Purposes of Board <br /> <br /> The purposes of the Architectural Board of Review are to protect the value, <br />appearance and use of property on which buildings are constructed or altered, to maintain <br />a high character of community development, to protect the public health, safety, <br />convenience and welfare and to protect real estate within the City from impairment or <br />destruction of value. Such purposes shall be accomplished by the Board by regulating, <br />according to accepted and recognized architectural principles, the design use of materials, <br />finished grade lines, dimensions, orientation and location of all main and accessory <br />buildings to be erected, moved, altered, remodeled or repaired, subject to the provisions of <br />the Zoning and Building Codes and other applicable ordinances of the City, and shal take <br />into consideration the Architectural Standards Workbook which has been adopted by the <br />City. In reviewing, regulating and approving building plans, the Board shall consider and <br />take cognizance of the development of adjacent, contiguous and neighboring buildings and <br />properties for the purpose of achieving safe, harmonious and integrated development of <br />related properties. <br /> <br />Page I of 3 <br /> <br /> <br />
