PLACED ON <br />2ND READING 5/1/00. <br /> <br />ORDINANCE NO. ~$-00 <br /> <br />BY:Corrigan, FitzGerald, <br />George, Roth, Seelie, Skindell <br /> Smith. <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Director of Finance <br />to sell, through public auctions, various obsolete, surplus and non-functioning City vehicles, <br />materials and/or equipment. <br /> <br /> WHEREAS, it is in the best interest of the City to sell this obsolete, surplus and non- <br />functi.oning equipment to make better use of the space it occupies and to realize a profit <br />f~om the sale, and <br /> <br /> WHEREAS, an emergency exists to provide for the immediate preservation of public <br />property, health and safety, and to provide for the usual daily operation of municipal <br />departments, now therefore: <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Finance be and 'she is hereby authorized and <br />directed to sell, through public auctions, held in the spring and the fall, various obsolete, <br />surplus and non-functioning City vehicles, materials and/or equipment after advertising <br />according to law. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to th6 passage of this ordinance were adopted in an open meeting of <br />this Council, and that all such deliberations of this Council and of any of its committees that <br />resulted in such formal action, were in meetings open to the public in compliance with all <br />legal requirements. <br /> <br /> Section 3. This ordinance is hereby declared to be an emergency measure for the <br />reasons stated in the preamble hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor, otherwise, it shall take effect and be in force <br /> <br />after the earliest period allowed by law. <br /> <br />President <br />M~tr ...... { "'"" ' <br /> <br /> <br />
