An ORDINANCE authorizing and approving the supplementation of Exhibit A to the Amended and Restated Lease, by and between the City of Lakewood as Lessor and Lakewood Hospital Association as Lessee, entered into on December 23, 1996 ("Lease"), to incorporate and include three pm'eels of real estate subsequently transferred to the City of Lakewood. WHEREAS, in order to accomplish the Lakewood Hospital Emergency Department expansion project, Lakewood Hospital Association has agreed to transfer title of three parcels of land bearing Permanent Parcel Number 314-07-018 (1471 Belle Avenue), Permanent Parcel 'Number 314-07-028 (1470 Marlowe Avenue), and Permanent Parcel Number 314-07-027 (1474 Marlowe Avenue), to the City of Lakewood; and WHEREAS, the Lease sets forth Exhibit A which describes and lists the leased real premises as defined in the Lease, which are maintained and operated by Lakewood Hospital Association pursuant to the terms of the Lease; and WHEREAS, pursuant to Section 14.6 of the Lease entitled Amendments, Changes and. Modifications., any amendments, changes, modifications, alterations or deletions to the Lease may be made provided that the same shall be authorized by ordinance passed by at least a two- thirds affirmative vote of the Council; and WHEREAS, the Lakewood Hospital Association Board of Trustees, at their regular meeting of October 26, 2000, passed a Resolution authorizing and approving the supplementation of the Lease to include the properties transferred by Lakewood Hospital Association to the City of Lakewood; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Exhibit A to the Lease between the City of Lakewood and Lakewood Hospital Association be and is hereby supplemented to include and incorporate the following properties transferred by Lakewood Hospital Association to the City 6f Lakewood, more fully described in attached Exhibits A- 5(1); A- 9(1); and A - 9(2), to wit: Permanent Parcel Number 314-0%018 (1471, Belle Avenue), Permanent Parcel Number 314-07-028 (1470 Marlowe Avenue); and Permanent Parcel Number 314-07-027 (1474 Marlowe Avenue). Section 2. Upon approval by this Council, said properties shall included and hereby integrated into the Amended and Restated Lease by and between the City of Lakewood and Lakewood Hospital Association, entered into on December 23, 1996. Section 3. It is found and determined that all formal actiOns of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
