Please substitute for Ordinance No. 71-00 <br />Placed on 1~t reading and referred to <br />Committee of the Whole 12/4/00 <br /> <br />ORDINANCE NO. 71-00 BY: Corrigan, FitzGerald, <br /> George, Roth, Seelie, Skindell, Smith <br />AN EMERGENCY ORDINANCE adopting the Plan of Operation and Governance for <br />the electricity aggregation program for the City of Lakewood and other members of the <br />Northeast Ohio Public Energy Council. <br /> <br /> WHEREAS, this council and the electors of the City of Lakewood have authorized <br />establishing an opt-out electricity aggregation program for the residents, businesses and <br />'other electric consumers in the City, and acting jointly with other Ohio municipal corporations, <br />townships and counties through the Northeast Ohio Public Energy Council (NOPEC), all <br />pursuant to Section 4928.20 of the Ohio Revised Code; and <br /> <br /> WHEREAS, NOPEC, on behalf of the City and other members of NOPEC, has held two <br />public hearings on and developed a Plan of Operation and Governance for the aggregation <br />program; <br /> <br /> WHEREAS, this Ordinance is hereby declared to be an emergency measure as it <br />provides for the public health, safety and welfare, and further is declared to be an emerqency <br />as it provides for immediate steps necessary to the aqqreqation program. Now, Therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. This Council hereby adopts, the Plan of Operation and Governance <br />(attached hereto as Exhibit A). <br /> <br />Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this ordinance were. adopted '~n an open meeting of this Council, and <br />that all such deliberation of the Council and of any of its'committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br /> <br />Section 3. That this ordinance is hereby declared to be an emergency measure for the <br />reasons stated in the preamble hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take effect and be in force immediately upon <br />its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the <br />earliest period allowed by law. <br /> <br />Adopted:~/~'.t~ /~. ~ <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
