PLACED <br />ON 2ND READ 12/18/00. <br /> <br />ORDINANCE NO. 73"00 <br /> <br />BY: Corrigan, FitzGerald, George, <br />Roth, Seelie, Skindell, Smith. <br /> <br />AN EMERGENCY ORDINANCE to authorize the Mayor to make application <br />to the Cuyahoga County Board of Commissioners for approval to use County <br />Motor Vehicle License Tax Funds for the improvement of Hilliard Boulevard (CR- <br />69)/Franklin Boulevard (CR-435) from the Lakewood West Corporation Line to <br />Lakeland Rood and to enter into an agreement with Cuyahoga County necessary <br />to complete the planning and construction of this improvement. <br /> <br />WHEREAS, the City of Lakewood recognizes the need for and proposes <br />the improvement of a portion of public highway described as follows: <br /> <br />The repair and resurfacing of Hilliard Boulevard (CR-69)/Franklin <br />Boulevard (CI<-435) from the Lakewood West Corporation Line to Lakeland Road. <br /> <br />WHEREAS, this Ordinance is hereby declared to be an emergency measure as it <br />provides for the usual daily Operotion of a municipal department and it is required to permit <br />immediate construction that is necessary to protect vehicular and pedestrian traffic. Now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br />Section 1. <br /> <br />A. CONSENT <br />1. It is declared to be in the public interest that the consent of the <br />City of Lakewood be and such consent is hereby given to the <br />County to construct the abqve described improvement in <br />ocçordance with plan, specifications and estimates approved by the <br />County. <br /> <br />B. COOPERATION <br />1. Thot the County and the City of Lokewood will cooperate in the <br />repair and resurfacing of Hilliard Boulevard (CR-69)/Franklin <br />BOulevard (cr-435) from the Lokewood West Corporotion Line to <br />Lakeland Road. <br />2. That the County will arrange for the preparation of construction <br />plans and sþecifications, including necessary engineering reports <br />for improvement, under current Cuyahoga County Engineer <br />standards for construction of County roads and bridges. <br />3. That the County will arrange for the supervision and administration <br />of the construction contract. <br /> <br />C. FUNDING <br />1. TlÎat the City of Lakewood hereby agrees to participate with the <br />County In the cost of the improvement by 'an allocation from the <br />County Motor Vehicle License Tox Fund to pay the County portion <br />of the project. <br />2. That if funds administered by the Ohio Public Works Commission <br />ore used for this project, the amount of such funds will be <br /> <br />¡¿:-, <br /> <br />, ' <br />
