PLACED ON 1ST READING & REFERRED TO <br />COMMITTEE OF THE WHOLE 9/17/01. <br /> <br />]?LACED ON 2ND READING 10/1/01, <br /> <br />ORDINANCE NO. 37-01 <br /> <br /> BY: Corrigan, FitzGerald, <br />George, Roth, Seelie, Skindell, Smith. <br /> <br /> AN EMERGENCY ORDINANCE fixing the compensation, of the Probation Officer of the <br />Lakewood Municipal Court and the time ~and method of payment. <br /> <br /> WHEREAS, the Municipal Court Act, Revised Code Section 1901.33 provides that the <br />legislative authority of a municipality shall fix the compensation of the Probation Officer appointed <br />by the Judge of a Municipal Court and, <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily <br />operation of a municipal department in that in the interest of public service, welfare and safety, it is <br />necessary to fix the compensation of'the said Probation Office and direct the time and. method of <br />payment thereof, now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the compensation of the Probation Officer of the Lakewood Municipal <br />Court is hereby fixed at the aggregate sum of Forty Four Thousand One Hundred Dollars per <br />annum effective April 1; 2001. <br /> <br /> Section 2. That the Director of Finance is hereby authorized and directed to pay said <br />compensation of the Probation Officer as herein fixed, from the City Treasury in semi-monthly <br />installments of equal installments every two weeks. <br /> <br /> Section 3. That Ordinance No. 46-00 adopted October 3, 2000, and all, other ordinances <br />or parts of ordinances inconsistent herewith shall be and are hereby repealed. <br /> <br /> Section 4. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its committees that resulted in such formal <br />actions were in meeting open to the public in compliance with all legal requirements. <br /> <br /> Section 5. That this ordinance is hereby declared to be an emergency measure for the <br />reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of <br />all members' elected to Council, it shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor, otherwise, it shall take effect and be in force after the earliest period <br />allowed by law. <br /> <br />President <br />Mayor / <br /> <br /> <br />
