ORDINANCE NO: <br /> <br />43-01 <br /> <br />PLACED ON 1ST READING & REFERRED TO <br />THE COMMITTEE OF THE WHOLE 9/17/01. <br /> <br /> 2nd Read i0/1/01. <br /> BY: Corrigan, FitzGerald, George, <br /> Roth, Seelie, SkindeI1, Smith. <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor or her designee to engage contracting <br />firms to provide professional services in the design and preparation of specifications and contract <br />administration and to advertise for bids and enter into a contract with the lowest and best bidder for <br />Asbestos-Containing Materials (ACMs) Removal and Building Demolition in accordance with the <br />Administrative Code of the City of Lakewood, contracts not to exceed the specified amounts shown without <br />separate Resolution of Council. <br /> <br /> WHEREAS, an emergency exists to provide for the immediate preservation of the public property, <br />health and safety, and to provide for the environmental remediation prior to the sale of the property located at <br />11726-28 Detroit Avenue and 1385-87 Hird Avenue (PPg 312-33-017), Lakewood, Ohio and further, best <br />prices would be more readily obtainable as soon as possible. NOW, WI-IEREFORE, <br /> <br />BE 1T ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OItlO: <br /> <br /> Section 1. That Council of the City of Lakewood hereby authorizes the Mayor or her designee to <br /> engage contracting firms to provide professional services in the design and preparation of specifications and <br />'contract administration and to advertise for bids and enter into a contract with the lowest and best bidder in <br /> accordance with the Administrative Code of the City of Lakewood for the following ACMs and demolition, <br /> contracts not to exceed the specified amounts shown, except as hereinafter provided: <br /> <br />Asbestos-Containing Materials (ACMs) removal from Building 1 <br />and Building 2 located at 11726-28 Detroit Avenue <br />Demolition of Building #3 located at 1385-87 Hird Avenue <br /> <br />$200,000 <br /> 75,000 <br /> <br /> Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and any of its committees that resulted in such formal actions, were in meetings <br />open to the public in compliance with all legal requirements. <br /> <br /> Section 3. This Ordinance is hereby declared to be an emergency measure for the reasons set <br />forth and defined in the preamble of this Ordinance, and provided it receives the affirmative vote of at least <br />five (5) of its members elected to Council, this Ordinance shall take effect and be in force immediately upon <br />its adoption by the Council and approval by the Mayor; otherwise it shall take effect and be in force after the <br />earliest period allowed by law. <br /> <br />pted : "- <br />Ado : r <br /> <br />President <br /> <br />Clerk of Co)/ncil (.~ <br />Mayor / <br /> <br /> <br />
