<br />~ <br /> <br />r-" <br /> <br />PLACED ON 1ST READING & REFERRED TO <br />RULES & ORDINANcES C~E '1/5/01. <br />PLACED ON 2ND READING 11/19/01. <br /> <br />ORDINANCE NO. 55-01 <br /> <br />BY: Corrigan, FitzGerald, George, <br />Roth, Seelie, Skindel1, Smith. <br /> <br />AN EMERGENCY ORDINANCE to create amend Section 351.16, Displaying Autos <br />for Sale; Advertising, of the Codified Ordinances of the City of Lakewood for the <br />purpose of restricting washing and repairing motor vehicles on the street. <br /> <br />WHEREAS, recently, safety issues have arisen in the City of Lakewood related to <br />parking and the repair of vehicles in the public right of way; and <br /> <br />WHEREAS, these public safety concerns have caused the City to remove parking <br />meter heads and to restrict parking during peak business hours in certain areas; and <br /> <br />WHEREAS, in order to safely restore parking in these areas, it is necessary to <br />regulate the repair and/or washing of vehicles in the public right of way; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the eárliest date possible as set forth in ARTICLE III, SECfONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE OTY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, in <br />that the on street parking in certain areas of the City of Lakewood can not be safely <br />restored without this legislation. Now Therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That Section 351.16, Displaying Autos for Sale; Advertising, <br />currently reading as follows: <br /> <br />351.16 DISPLAYING AUTOS FOR SALE; ADVERTISING. <br />(a) No person shall stand or park a vehicle on any street or in any <br />public right of way in the City for the preliminary purpose of displaying such <br />vehicle for sale or for the primary purpose of displaying advertising. <br /> <br />(b) , This section shall not apply to the placing of signage on a personal <br />vehicle advertising that vehicle for sale, so long as the signage is placed inside <br />the vehicle and does not significantly obstruct the view of the driver so as to <br />interfere with the safe operation of such vehicle and so long as such vehicle is <br />not parked or stood upon a public street or public right o(way for the primary <br />purpose of advertising that vehicle for sale. <br /> <br />shall be and is hereby amended to read as follows: <br /> <br />351.16 DISPLAYING VEHICLES FOR SALE; ADVERTISING; REPAIRING OR <br />WASHING VEHICLE. <br /> <br />(a) No person shall stand or park a vehicle on any street or in any <br />public right of way in the City for the principal purpose of displaying such vehicle <br />for sale; or for washing, greasing, or repairing such vehicle; or for the primary <br />purpose of displaying advertising, <br /> <br />(b) This section shall not appiy to the placing of signage on a personal <br />vehicle advertising that vehicle for sale, so long as the signage is placed inside <br />the vehicle and does not significantly obstruct the view of the driver so as to <br />
