PLACED ON tST READING & KEFERRED TO THE <br />RULES & ORDINANCES COMMITEE. 7/30/02. <br /> <br />ORDINANCE NO. 132-02 <br /> <br /> BY; Corri§an, Duz~n, FitzGerald, <br />George, Ro~h, Seelie, Sk/n~ell. <br /> <br /> AN EMERGENCY ORDINANCE approving the plan of operation and governance for <br />the NOPEC Gas Aggregation Program for the Purpose of jointiy establishing and implementing a <br />Gas Aggregation Program.. <br /> <br /> WHEREAS, this Coundl previously enacted legislation authorizing the City to establish <br />a Gas Aggregation Program pursuant to Section 4929.26, Ohio Revised Code (the ~Gas <br />Aggregation Program"), for the eligible residents, businesses and other gas consumers in the City, <br />and for that purpose, to act jointly with any other munidpal corporation, city, county or other <br />political subdivision of the State of Ohio, as permitted by law; and <br /> <br /> WHEREAS, on behalf of this Council pursuant to Section 4929.26, Ohio Revised Code, <br />two (2) public hearings have been held on the Plan of Operation and Governance for the NOPEC <br />Gas Aggregation Program; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance Is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as set forth in AETICLE III, SECrONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE ~ OF LAKEWOOD, and that it is necessary for the <br />immediate preservation of the public property, health and safety, and to provide for the usual <br />daily operation of municipal departments in that the City was presented with a August [5, 2002 <br />deadline to either take all necessary action to participate in this program. Now Therefore, <br /> <br />BE 1'1' ORDAINED BYTHE Ci'I'Y OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. This Council finds and determines that it Is tn the best interest of the City, <br />including the gas consumers locate! within the City to adopt the Plan of Operation and <br />Governance of the NOPEC Gas Aggregation Program (a copy of which is on file with the Clerk of <br />Coundl), for the purpose of establishing and implementing the Gas Aggregation Program in the <br />City. <br /> <br /> Section 2. It Is found and determined that all formal actions.of this Councii <br />concerning and relating to the passage of this ordinance were adopted in an open meeting of <br />this Council, and that all such deliberation of the Coundl and of any of its committees that <br />resulted in such formal action were In meetings open to the public in compliance with all legal <br />requirements. <br /> <br /> Section 3. That thls ordinance is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety and <br />welfare in the City and for the usual daily operation of the City for the reasons set forth and <br />defined in the preamble to this ordinance, and provided It receives the affirmative vote of at <br />least five (5) of its members elected to Council, this ordinance shall take effect and be in force <br />immediately upon its adoption by the Coundl and approval by the Mayor otherwisa, it shall take <br />effect and be in force after the eadlest period allowed by law. <br /> <br />President of Coundl <br /> <br /> <br />
