Please SubstibJte for Ordinance No. 135-02. <br />(Placed on 1~ Reading 8/12/02, Placed on 2"d <br />Reading and Referred to Committee of the <br />Whole 8/20/02.) <br /> <br />Ordinance No. 135-02 <br /> <br />BY:Corrigan, Dunn~ ~t~zGerald, <br /> Roch, Seelle. <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor (Director of Public Safety), <br />the Director of Public Works, the Director of Law, the Director of Finance, and/or the <br />Procurement Officer to enter into conb'acts for professional services, and to purchase <br />any and all supplies, services and equipment as necessary for the West Nile Virus <br />Prevention Program as authorized by the 2002 Appropriation Ordinances and the <br />administrative Code of the City of Lakewood. <br /> <br /> WHEREAS, this Coundl by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date pOssible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE Cl'TY OF LAKEWOOD, and that it is <br />necessary for the Immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that contracting <br />authority is necessary to take prophylactic steps against the spread of the West Nile <br />Virus. Now Therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Mayor (Director of Public Safety), the Director of Public <br />Works, the Director of Law, the Director of Rnance, and/or the Procurement Officer be <br />and are hereby authorized and directed to enter into a contract or contracts for <br />supplies, services and/or equipment as necessary to control West Nile Virus, as follows: <br /> <br />West Nile Virus Prevention ....................... $ .85,000 <br /> <br /> Section 2. Coundl hereby determines that these contracts are neces__~ry to <br />meet an emergency arising In connection with the operation or maintenance of a City <br />department or agency or that it is either impractical to award the contract under <br />competitive bidding procedures, or cost-effective and in the best interests of the City to <br />award the contracts without competitive bidding. <br /> <br /> Section 3. It is found and determined that ali formal actions of this Coundl <br />concerning and relating to the passage of this ordinance were adopted In an open <br />meeting of this Council, and that all such deliberations of this Coundl and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual dally operaUon of the City for <br />the masons set forth and defined in the preamble to this ordinance, and provkled it <br />receives the affirmaUve vote of at least five ($) of its members elected to Council, this <br />ordinance shall take effect and be in force immediately upon its adoption by the Coundl <br /> <br /> <br />
