ORDINANCE NO. 147-02 BY: corrigan, Dunn, FitzGerald, George, Ro~h, Seelie, Skindell. AN EMERGENCY ORDINANCE authorizing the Director of Public Works to enter into contracts for an amount not to exceed Thirty Thousand Dollars ($30,000) and declaring said contracts to be necessary to meet an emergency arising with the operation and maintenance of the City sawer system located on Belle Avenue between Madison Avenue and Franklin Boulevard. WHEREAS, approximately 70 feet of sanitary sewer located below Belie Avenue between Madison and Franklin has collapsed; and WHEREAS, immediate .action is necessary to prevent homes on Belle Avenue from being cut off from the City's sanitary sewer system; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and :[3 of the SECOND AMENDED CHARTER OF THE CTrY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of munidpal departments in that the provision of ~ewer sarvices to residents on Belle Avenue will not be possible without Immediate Intervention. Now Therefore, BE 1'1' ORDA[NED BY THE c/mY OF LAKEWOOD, STATE OF OHIO Section 1. That the Director of Public Works is hereby authorized to enter Into contracts for an amount not to exceed Thirty Thousand Dollars ($30,000) for the repair and/or ~eplacement of the Ob/owned sawer below Belle Avenue between Madison Avenue and Franklin Boulevard as may be necessary. Section 2. This ~:oundl hereby declares said contracts to 'be necessary to meet an emergency adsing with the operation and maintenance of the City sawer system located below Belle Avenue, pursuant to Lakewood Codified Ordinance §l:tl.0~t(a)(3). Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. That this ordinance is hereby declared to be an emergency measure necessary for the Immediate preservation of the public peace, property, health, safety and welfare in the Oty and for the usual daily operation of the City for the reasons sat forbh and defined In the preamble to this ordinance, and provided it receives the affirmative vote of at least five (5) of its members elected to Coundl, this ordinance shall take effect and be in force immediately upon its adoption by the Council
