ORDINANCE NO. ~49-o~ <br /> <br />Please Substitute for Ordinance No. 149-02. <br />(Placed on Is: Reading and Referred to :he <br />Cormmit:ee of the Whole 11/18/02.) <br /> Second R~ading i2/2/02. <br /> <br /> BY' Corrigan, Dunn, FitzGerald, <br /> George, ~eelie, Skindell. <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Council President, with the <br />concurrence of the majority of Council, to engage firms to provide professional services <br />relating to the Proposed West End Development Project in the City of Lakewood, in <br />accordance with the Administrative Code of the City of Lakewood, contracts not to <br />exceed the specified amounts shown without separate resolution of Councii. <br /> <br /> WHEREAS, this Coundl by a vote of at Feast five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in AR'F[CLE TTI, SECTONS 10 and 13 <br />of the SECOND AMENDED CHARTER OF THE CTI-Y 01= LAKEWOOD, and that it is <br />necessary to provide for the usual daily operation of municipal departments in that <br />Council needs their own consultants in order to assess the West End Development <br />Project. Now therefore <br /> <br />BE TT ORDAINED BY THE CI-I'Y OF LAKEWOOD, STATE OF OHIO <br /> <br /> SecUon 1. That the President of Coundl, with the concurrence of the <br />majodty of Council, is hereby authorized to engage firms to provide professional <br />services relating to the West End Development Project in the City of Lakewood, in <br />accordance with the Administrative Code of the City of Lakewood, contracts not to <br />exceed the specified amounts Shown, except as hereinafter provided: <br /> <br />Professional Services/Proposed West End DeVelopment Project $10,000 <br /> <br /> Section 2. That the Council President [s hereby authorized and directed to <br />enter int~ contracts as set forth above Jn amounts not to exceed the specified amounts <br />without further action from Council; and to enter into contracts in excess of specified <br />amounts only upon consent of Council evidenced by adoption of a resolution specifying <br />the authorized amount. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in an <br />open meeting of this Coundl, and that all such deliberations of this Coundl and of any <br />of its committees that resulted in such formal action were in meetings open to the <br />public in compliance with-all legal requirements. <br /> <br /> Section 4. 'Fha t this ordinance is hereby declared to be an emergency <br />measure for the reasons set forth and defined in the preamble to this ordinance, and <br />provided it receives the afffrmat~ve vote of at least five (5) of its members elected to <br />Coundl, this ordinance shall take effect and be in force immediately upon its adoption <br />by the Council and approval by the Mayor otherwise, it shall take effect and be in force <br />affcer the earliest per/od allowed by law. <br /> <br />Adopted: <br /> <br />President of COuncil <br /> <br /> <br />
