AN ORDINANCE to amend section 529.04, Liquor Consumption in Motor Vehicle, of the Codified Ordinances of the City of Lakewood for the purpose of excluding the consumption of liquor in a limousine as permitted by Lakewood Codified Ordinance 529.07 as a violation of this offense and to remain consistent with the Ohio Revised Code. WHEREAS, this ordinance is necessary for the public health, welfare and safety. Now therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That section 529.04, Liquor Consumption in Motor Vehicle, of the Codified Ordinances of the City of Lakewood currently reading as follows 529.04 LIQUOR CONSUMP'F/ON IN MOTOR VEHICLE. (a) No person shall consume any beer or intoxicating liquor in a motor vehicle. (bi Whoever violates this section is guilty of a misdemeanor of the fourth degree. shall be and is hereby amended to read as follows: 529.04 LIQUOR CONSUMPTION IN MOTOR VEHICLE. (a) No person shall consume any beer or intoxicating liquor in a motor vehicle. This section does not apply to persons described in Section 529.07(d). (bi Whoever violates this section is guilty of a misdemeanor of the fourth degree. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
