PLACED ON 1ST READING & REFERRED TO THE RULES & <br />ORDINANCES CMTE 2/19J02. <br />PLACED ON. 2ND READING 3/4/02. <br /> <br />ORDINANCE NO. 31-02 BY: CorriEa~, Dunn, FitzGe=ald, <br /> George, Roth, Seelie, Skindell. <br /> <br /> AN ORDINANCE to amend section 533.06, Voyeurism, of the Codified Ordinances <br />of the City of Lakewood for the purpose of expanding the crime, creating new penalties <br />and remaining consistent with the Ohio Revised Code. <br /> <br /> WHEREAS, this ordinance is necessary for the Public health, welfare and safety. <br />Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That section 533.06, Voyeurism, of the Codified Ordinances of the <br />City of Lakewood currently reading as follows: <br /> <br /> 533.06 VOYEURISM. <br /> (a) No person, for the purpose of sexually arousing or gratifying himse f or <br />herself, shall Commit trespass or otherwise surreptitiously invade the privacy of another, <br />to spy or eavesdrop upon another. <br /> <br /> (bi Whoever violates this secUon is guilty of voyeurism, a misdemeanor of the <br />third degree. <br /> <br />shall be and is hereby amended to read as follows: <br /> <br /> 533.06 VOYEUPJSM. <br /> (a) No person, for the purpose of sexually arousing or gratifying himself or <br />herself, shall commit trespass or otherwise surreptitiously invade the privacy of another, <br />to spy or eavesdrop upon another. <br /> <br /> (bi No person, for the purpose of sexually arousing or gratifying the person's <br />self, shall commit trespass or otherwise surreptitiously invade the privacy of another to <br />photograph the other person in a state of nudity. <br /> <br /> (c) No person, for the purpose of sexually arousing or gratifying the person's <br />self, shall commit trespass or otherwise surreptitiously invade the privacy of another to <br />photograph the other person in a state of nudity if the other person is a minor. <br /> <br /> (d) No person shall secreUy or surreptitiously videotape, film, photograph, or <br />otherwise record another person under or through the clothing being worn by that <br />other person for the purpose of viewing the body of, or the undergarments worn by~ <br />that other person. <br /> <br />(e) (1) Whoever violates this section is guilty of voyeurism. <br /> (2) A violation of subsection (a) hereof is a misdemeanor of the third <br /> degree. <br /> (3) A violation of subsection (bi hereof is a misdemeanor of the second <br /> degree. <br /> (4) A violation of subsection (c) or (d) hereof is a misdemeanor of the first <br /> degree. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br /> <br /> <br />
