Z/.~,9~02, ~"'~ ,U,,W <br /> <br />ORDINANCE NO. 36-02 BY: Corrigau, Duan, Fitzgerald, <br /> George, l~oth, Seelie, Sl~f~ndell. <br /> <br /> AN ORDINANCE to amend section 537.04, Negligent Assault, of the Codified <br />Ordinances of the City of Lakewood for the purpose of including harm to another's <br />unborn and to remain consistent with the Ohio Revised Code. <br /> <br /> WHEREAS, this ordinance Is necessary for the public health, welfare and safety. <br />Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That section 537.04, Negligent Assault, of the Codified Ordinances <br />of the City of Lakewood currently reading as follows: <br /> <br /> 537.04 NEGLIGENT ASSAULT. <br /> {a} No person shall negligently, by means of a deadly weapon or dangerous <br />ordnance as defined in Section 549.01, cause physical harm to another. <br /> <br /> (b) Whoever violates thls section is guilty of negligent assault, a misdemeanor <br />of the third degree. <br /> <br />shall be and Is hereby, amended to read as follows: <br /> <br /> 537.04 NEGLIGENT ASSAULT. <br /> (a) <br /> No person shall negllgenUy, by means of a deadly weapon or dangerous <br />ordnan~ as defined in Section 549.01, .cause physical harm to another or to an6ther's <br />unborn. <br /> <br /> (b) Whoever violates this section is guilty of negligent assault, a misdemeanor <br />of the third degree. <br /> <br /> Section 2.
