ORDINANCE NO. 39-03 BY: Corrigan, Dever, Dunn, FitzGerald, George, Roth, Seelie. AN EMERGENCY ORDINANCE to authorize the Mayor to make application to the Cuyahoga County Board of Commissioners for approval to use County Motor Vehicle License Tax Funds for the improvement of Hilliard Boulevard (CR- 69)/Franklin Boulevard (CR-435) from Lakeland Road to Bunts Road and to enter into an agreement with Cuyahoga County necessary to complete the planning and construction of this improvement. WHEREAS, the City of Lakewood recognizes the need for and proposes the improvement of a portion of public highway described as follows: The repair and ~esurfacing of Hilliard Boulevard (CR-69)/Franklin Boulevard (CR-435) from Lakeland Road to Bunts Road. WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance, is an emergency measure, and that this ordinance shall take effect at the earliest date possib!e as set forth in ARTZCLE IIi, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CI'TY OF LAKE'WOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that this legislation is necessary to complete the second phase of the Hilliard Boulevard/Franklin Boulevard reconstruction project. Now Therefore, ' BE 1T ORDAtNED BY THE COUNCIL OF THE ClTY OF LAKEWOOD, STATE OF OHIO: Section 1. CONSENT. 1. It is declared to be in the public interest that the consent of the · City of Lakewood be and such consent is hereby given to the County to construct the above described improvement in accordance with plans specifications and estimateS approved by the County. COOPERATION 1. That the County and the City of Lakewood will cooperate In the repair and resurfacing of Hilliard Boulevard (CR-69)/Franklin Boulevard (Cr~435) from Lakeland Avenue to Bunts Road. 2. That the County will arrange for the preparation of construction plans and specifications, including necessary engineering reports for improvement, under current Cuyahoga' County standards for construction of County roads and bridges. 3. That the County will arrange for the supervision and administration of the construction contract. C. FUNDING 1. That the City of Lakewood hereby agrees to participate with the County in the cost of the improvement by an allocation from the County Motor Vehicle License Tax Fund to pay the County portion of the project.
