ORDINANCE NO. 44-03 BY: corrigan, Dever, Dunn, <br /> George, Roth, Seelie. <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public Works to enter <br />into contracts for an amount not to exceed Thirty Thousand Dollars ($30,000) and <br />declaring said contracts to be necessary to meet an emergency arising with the <br />operation and maintenance of the City sewer system located on Rosalie Avenue, north <br />of Lake Avenue. <br /> <br /> WHEREAS, approximately 40 feet of City maintained sanitary sewer located <br />below Rosalie Avenue, north of Lake Avenue has collapsed; and <br /> <br /> WHEREAS, immediate action is necessary to prevent homes on Rosalie Avenue <br />from being cut off from the City's sanitary sewer system; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that the provision <br />of sewer services to residents on Belle Avenue will not be possible without immediate <br />intervention. Now Therefore, <br /> <br /> BE ~T ORDAINED BY THE C~TY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Director of Public Works is hereby authorized to enter into <br /> contracts for an amount not to exceed Thirty Thousand Dollars ($30,000) for the repair <br /> and/or replacement of the City owned sewer below Rosalie Avenue, north of Lake <br /> Avenue as may be necessary. <br /> <br /> Section 2. This Council hereby declares said contracts to be necessary to meet <br /> an emergency arising with the operation and maintenance of the City maintained sewer <br /> system located below Rosalie Avenue and private property, pursuant to Lakewood <br /> Codified Ordinance §111.04(a)(3). <br /> <br /> Section 3. It is found and determined that all formal actions of this Council <br /> concerning and relating to the passage of this ordinance were adopted in an open <br /> meeting of this Council, and that all such deliberation of the Council and of any of its <br /> committees that resulted in such formal action were in meetings open to the public in <br /> compliance with all legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br /> measure necessary for the immediate preservation of the public peace, property, <br /> health, safety and welfare in the City and for the usual daily operation of the City for <br /> the reasons set forth and defined in the preamble to this ordinance, and provided it <br /> receives the affirmative vote of at least five (5) of its members elected to Council, this <br /> <br /> <br />
