ORDINANCE NO. 63-03 <br /> <br />FitzGerald, George, Roth, Seelie. <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Pubtic Works to enter <br />into contracts for an amount not to exceed Sixty Thousand Dollars ($60,000) and <br />declaring said contracts to be necessary to meet an emergency arising with the <br />operation and maintenance of the City sewer system located on Summit Avenue at the <br />intersection of Clifton Boulevard. <br /> <br /> WHEREAS, approximately 20 feet of City sanitary sewer located below Summit <br />Avenue at the intersection of Clifton Boulevard has collapsed; and <br /> <br /> WHEREAS, immediate action ismecessary to prevent homes Summit Avenue from <br />being cut off from the City's sanitary sewer system; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEVVOOD, and that it is <br />neceasa~y for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of munidpal departments in that the provision <br />of sewer services to residents on Belle Avenue will not be poSSible without immediate <br />intervention. Now Therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Director of Public Works is hereby authorized to enter into <br />contracts for an amount not to exceed Sixty Thousand Dollars ($60,000) for the repair <br />and/or replacement of the City owned sewer below Summit Avenue at the intersection <br />of Clifton Boulevard as may be necessary. <br /> <br /> Section 2. This Council hereby declares said contracts to be necessary to meet <br />an emergency arising with the operation and maintenance of the City sewer system <br />located below Summit Avenue, pursuant to Lakewood Codified Ordinance <br />§111.04(a)(3). <br /> <br /> Section 3. It is found and determined that all formal actions of this Coundl <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with ail legal requirements. <br /> <br /> Section ,I-. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual daily operation of the City for <br />the reasons set forth and defined in the preamble to this ordinance, and provided it <br />receives the affirmative vote of at least five (5) of its members elected to Council, this <br /> <br /> <br />
