<br />AN EMERGENCY ORDINANCE adjusting appropriations for expenditures in the General Fund for the
<br />fiscal year ending December 31, 2003 for the purposes of accepting payment of an economic development
<br />grant from Cuyahoga County in the amount of Three Hundred Eighty-Seven Thousand Seven Hundred
<br />Twenty-Two Dollars ($387,722.00), which in turn shall be applied by the City toward payment of
<br />expenditures related to the Hinkley Lighting, Inc. retention and expansion project at 12600 and 12750
<br />Berea Road, Lakewood, Ohio.
<br />
<br />WHEREAS, pursuant to the Lakewood Community VIsion, and the Berea Road, West 111' Street
<br />Study, Berea Road is recommended to be maintained and strengthened as an important industrial corridor
<br />within the City of Lakewood; and
<br />
<br />WHEREAS, Hink[ey Lighting is a Lakewood-based manufacturing company that has been in
<br />existence since 1922 and in Lakewood for over twenty-five years as an anchor business on Berea Road; and
<br />
<br />WHEREAS, it is in the public interest to see that Hink[ey Lighting, Inc. is retained and expanded in
<br />Lakewood thereby ensuring the continued operation at this site of an economically viable and tax
<br />generating business; and
<br />
<br />WHEREAS, the City of Lakewood has completed a Phase I and Phase II Environmenta[ Assessment
<br />of the property utilizing Community Deve[opment B[ock Grant dollars through the Econom[c Development
<br />Fund Program; and
<br />
<br />WHEREAS, this assessment determined the need for various site improvements including
<br />environm¡zntal remediation prior to the expansion and construction by Hinkley Lighting, Inc. of a new
<br />distribution and warehouse facility at this location; and
<br />
<br />WHEREAS, the Board of Commissioners of Cuyahoga County, through Reso[ution Numbers 033413
<br />passed August 26, 2003, 033557 passed September 2, 2003 and 033901 passed September 30, 2003
<br />approved preparation and execution of a contract and appropriation of funds for an economic development
<br />grant to the City of Lakewood for the purpose of assisting the Hinkley Lighting, Inc. expansion project; and
<br />
<br />WHEREAS, Emergency Resolution 7811-03, adopted September 15, 2003, authorized the Mayor or
<br />her designee to enter Into an agreement with Cuyahoga County Department of Development for the
<br />purposes of accepting an economic development grant for site improvements and other costs related to the
<br />Hinkley Light[ng, Inc. expansion project; and
<br />
<br />WHEREAS, appropriations are needed, of Three Hundred Eighty-Seven Thousand Seven Hundred
<br />Twenty-Two Doliars ($387,722.00) to refiect such payment from the economic development grant from
<br />Cuyahoga County; and
<br />
<br />WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this
<br />ordInance is an emergency measurer and that this ordinance shall take effect at the-earliest date possible
<br />as set forth in ARTICLE III, SECITONS 10 and 13 of the SECOND AMENDED CHARTER OF THE cm OF
<br />LAKEWOOD, to provide for the immediate preservation of the of the public property, health and safety, and
<br />to provide for the timely reimbursement to Hink[ey Lighting, Inc. for eligible costs associated with this
<br />important industrial expansion project. NOW, THEREFORE,

<br />BE IT ORDAINED BY THE cm OF LAKEWOOD, STATE OF OHIO:

<br />Section 1. That the D[rector of Finance is hereby authorized and directed to increase
<br />appropriations in the fo[lowing fund by the amount stated beiow:
<br />
<br />General Fund
<br />
<br />$387,722.00
<br />
<br />Section 2. That the Director of Finance be and she is hereby authorized to draw checks upon
<br />the City depositories for the amounts appropriated in this ordinance whenever ciaims are presented
<br />properly, approved by the head of the department for which the indebtedness is Incurred, providing the
<br />President of Council shall approve all claims for the City Council.

<br />Section 3. It is found and determined that ali formal actions of this Council concerning and
<br />relating to the passage of this Ordinance were adopted [ii an open meeting of this Council, and that ali such
<br />deliberations of this Council and any of Its committees that resulted in such formal actions, were in
<br />meetings open to the public in compliance with all legal requirements.

<br />SectIon 4. This Ordinance is hereby declared to be an emergency measure for the reasons set
<br />forth and defined in the preamble of this Ordinance, and provided [t receives the affirmative vote of at [east
<br />five (5) of its members eiected to Councii, this Ordinance shall take effect and be in force Immediately upon
<br />its adoption by the Council and approval by the Mayor; otherwise it shall take effect and be in force after
