PLACED ON 2ND READING 2/2/04. <br /> <br /> ORDINANCE NO. 1-04 BY: Corrigan, Demro, Dever, Dunn, FitzGerald, <br /> Madigan, Seelie. <br /> <br /> AN EMERGENCY ORDINANCE to enact a new gection of Chapter 129 of the <br />Codified Ordinances of the Ci~ of Lakewood establis6ing the Eederal Emergency <br />Management Agency Eund (FEMA), for the purpose df receiving mon'es from FEMA for <br />the payment of certain salaries, fringe benefits, and ~se of equipment and vehicles <br />associated with the black-out August :t4-1S, 2003. <br /> WHERE~S, the City of Lakewood has been aw!rded a grant from the Federal <br />Emergency Management Agency for the reimbursement of the cost of sa aries, fringe <br />benefits, and use of equipment and vehicles during the black-out. <br /> <br /> WHEREAS, a special revenue fund will permit the City to properly track the <br />federal revenue and expenditures relating to this gra~t; and <br /> <br /> WHEREAS, this Council by a vote of at least fi~e ($) members ejected thereto <br />d term~nes that this ordinance m an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth i~ ARTICLE III, SECTIONS :tO and <br />:t3 of the SECOND AMENDED CHARTER OF THE C1T~, OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal ~epartments in that the services <br />and costs for this program have already been incurre;d. <br /> <br /> BE 1T ORDAINED BY THE C1-FY OF LAKEWOO~, STATE OF OHIO: <br /> Section 1. Establishment. There is hereby ~stablished a Special Revenue <br />Fund which shall be known and referred to as the Federal Emergency Management <br />Fund. The Director of Finance is hereby authorized ~nd directed forthwith to take such <br />action and to make such records as may be necessar~ to establish the Federal <br />Emergency Management Fund and thereafter to show its existence and condition at all <br />times upon the proper records of the City. <br /> <br /> Sc:'~tion 2. Money for Fund. All revenues derived from the Federal Emergency <br />Management Agency shall be kept and maintained inlia separate fund hereby <br />designated as the Federal Emergency Management Agency Fund, <br /> <br /> All <br /> Section 3. Authorized Expenditures, ex.plenoitures incurred for services <br />meeting the criteria of the grant shall' be paid from this fund. <br /> <br /> Section 4. Custody of Fund. The Director of Finance shall have possession and <br />custbdy of the Federal Emergency Management Func~ and the supervision of all <br />accounts with respect thereto. No further bond shall!be required of the Director of <br />Finance because of the Fund, but the Federal Emergency Management Fund shall be <br />under the protection of any bond heretofore given toithat may be given hereafter by <br />the Director of Finance. <br /> <br /> Section 5, R is found and determined that aill formal actions of this Council <br />concerning and relating to the passage of this r'esolu~ion were adopted in an open <br />meeting of this Council, and that all such del berat ons of th~s Counol and of any of its <br />committees that resulted in such formal action were i~ meetings open to the public in <br />compliance with all legal requirements. <br /> <br /> <br />
