ED QiLT ON, PLACED ON 2ND READING & <br />J ,~J¡\¡)1!.mFOR ADOPTION 1/3/05. <br />BY: Corrigan, Demro, Dever, Dunn, <br />FitzGerald, Madigan, Seelie. <br /> <br />AN EMERGENCY ORDINANCE declaring the necessity of submitting to the electors <br />of the City ofLalÅ“wood the question of expanding the use of two mills currently utilized for only <br />the sewage disposal plant to include financing the capital needs of street infrastructure, municipal <br />buildings, parks and recreation facilities <br /> <br />WHEREAS, the County Auditor for fiscal year 2005 has decreased the amount of <br />propèrty tax millage allocated for capital improvement purposes and increased the amount of <br />property tax millage allocated to the General Fund for operating purposes; and <br /> <br />WHEREAS, the City of Lake wood's funding source, primarily property tax, has <br />limitations on thè retirement of debt issued for capital improvements; and <br /> <br />WHEREAS, the City ofLakewood's capital needs continue to increase in the form of <br />street reconstruction, municipal buildings' renovations, and park improvements; and <br /> <br />WHEREAS, the future capital needs of the sewage disposal plant have been estimated to <br />require less than two mills of funding annually; and <br /> <br />WHEREAS, the City of Lake wood desires to submit such question to the electors of the <br />municipality at the next regular general or primary election; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />detemÜnes that this, ordinance is an emergency measure, and that this ordinance_shall take effect <br />at the ear¡¡estdate possible as set forth in ARTICLE ill, SECTIONS 10 and 13 of the SECOND <br />AMENDED CHARTER OF 1HE CITY OF LAKEWOOD, and that it is necessary for the <br />immediate preservation of the public property, health and safety, and to provide for the usual <br />daily operation of municipal departinents in that the City could potentially lose tax money if this <br />ordinance does not go into effect immediately upon passage. Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO that <br /> <br />Section 1. TIlls Council hereby authorizes and directs the subniission to the electors of <br />the City of Lakewood atthe next regular general or primary election to be held at the usual places <br />of voting of said municipality the question as to whether or not the City should expand the use of <br />two roills currently utilized for only the sewage disposal plant to include financing the capital <br />needs of street inftastructure, municipal buildings, parks and reçreation facilities <br /> <br />Section 2. The foregoing issue, upon receiving an affitrnative vote to expand the Use of <br />the property tax revenue by a majority of the electors voting thereon at the next regular general or <br />primary election, shaJI become effective immediately upon its adoption. <br /> <br />Section 3. The Clerk oftms Council is hereby authorized and directed promptly to <br />forward a certified copy of this Ordinance to the Board of Elections of Cuyahoga County <br /> <br />Section 4. The Board of Elections of Cuyahoga County shall cause an appropriate notice <br />to be duly given of the election to be held on the next regular general or primary election on the <br />foregoing issue relative to the City Charter of this municipality and otherwise to provide for such <br />election in the manner provided by the general laws of the State of Ohio <br /> <br />Section 5. The Clerk of Council is hereby authorized and directed to cause the full text <br />of such issue to be published once a week for two consecutive weeks in a newspaper published in <br />the municipality with the Írrst publication to be made at least fifteen (15) days prior to the general <br />election to be held on the next regular general or primary election. <br />
