Seelie. <br /> <br />AN EMERGENCY ORDINANCE committing the City of Lakewood to participate in a <br />street resurfacing program for the resurfacing of Detroit Avenue in the City of <br />Lakewood with the Ohio Department of Transportation. <br /> <br />WH EREAS, the City of Lakewood and State of Ohio have identified the need for <br />and proposed the improvement of the public highway which is described as follows: <br /> <br />Apply a face-to-face of curb surface treatment to Detroit Avenue (US-6A) <br />from approximately Sloane Avenue (US-20) to the East Corporation Line in <br />the City of LakewOQd, a total distance of 3.31 miles more or less; and <br /> <br />WHEREAS, said portion of highway is within the municipai corporation limits. <br /> <br />WHEREAS, this Council by a vote of at least five (5) members eiected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE 1lI, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CTIY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipai departments and for the scheduling <br />of street improvement projects. Now Therefore, <br /> <br />BE IT ORDIANED BY THE CTIY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That It is declared to be in the public interest that the consent of <br />said City be and such consent is hereby given to the Director of Transportation to <br />construct the above described improvement, in accordance with plans, specifications <br />and estimates as approved by the Director. <br /> <br />Section 2. That the City hereby requests the cooperation of the Director of <br />Transportation n in the cost of the above described improvement as follows: <br /> <br />The City agrees to assume and contribute twenty percent (20%) of the <br />cost and expense of the construction phase of this improvement <br />determined to be eligible for State Highway Funds. In addition, the City <br />, shall install and/or repair all curb ramps whiçh are necessary to ensure <br />compliance with the Americans with Disabilities Act and the LPA agrees to <br />assume and bear one hundred percent (100%) of the cost of such <br />installation and/or repair of curb ramps. <br /> <br />And further, the City agrees to assume and contribute one hundred <br />percent (100%) of the cost of any work included in the construction <br />contract, at the request of the City, which is determined by the Director <br />not to be part of or made necessary by the improvement. <br /> <br />Section 3. The City agrees that all right-of-way required for the described <br />project will be acquired and/or made available in accordance with current State and <br />Federal regulations. The City also understands that right-of-way costs include eligible <br />utility cOsts. The City agrees that all utility accommodation, relocation and <br />reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT <br />l.!tiJities Manual. <br />
