AN EMERGENCY ORDINANCE committing the City of Lakewood to participate in a street resurfacing program for the resurfacing of Detroit Avenue in the City of Lakewood with the Ohio Department of Transportation. WH EREAS, the City of Lakewood and State of Ohio have identified the need for and proposed the improvement of the public highway which is described as follows: Apply a face-to-face of curb surface treatment to Detroit Avenue (US-6A) from approximately Sloane Avenue (US-20) to the East Corporation Line in the City of LakewOQd, a total distance of 3.31 miles more or less; and WHEREAS, said portion of highway is within the municipai corporation limits. WHEREAS, this Council by a vote of at least five (5) members eiected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE 1lI, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CTIY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipai departments and for the scheduling of street improvement projects. Now Therefore, BE IT ORDIANED BY THE CTIY OF LAKEWOOD, STATE OF OHIO Section 1. That It is declared to be in the public interest that the consent of said City be and such consent is hereby given to the Director of Transportation to construct the above described improvement, in accordance with plans, specifications and estimates as approved by the Director. Section 2. That the City hereby requests the cooperation of the Director of Transportation n in the cost of the above described improvement as follows: The City agrees to assume and contribute twenty percent (20%) of the cost and expense of the construction phase of this improvement determined to be eligible for State Highway Funds. In addition, the City , shall install and/or repair all curb ramps whiçh are necessary to ensure compliance with the Americans with Disabilities Act and the LPA agrees to assume and bear one hundred percent (100%) of the cost of such installation and/or repair of curb ramps. And further, the City agrees to assume and contribute one hundred percent (100%) of the cost of any work included in the construction contract, at the request of the City, which is determined by the Director not to be part of or made necessary by the improvement. Section 3. The City agrees that all right-of-way required for the described project will be acquired and/or made available in accordance with current State and Federal regulations. The City also understands that right-of-way costs include eligible utility cOsts. The City agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT l.!tiJities Manual.
