<br />AN EMERGENCY ORDINANCE amending Ordinance No. 94-04, adopted November IS, 2004 for the
<br />purpose of changing the legal description and to vacate Cohassett Place in the City of lakewood, Ohio as
<br />part of the Board of Education of the lakewood City Schools school facilities project, the vacation of
<br />Cohassett Place is needed to faciiitate the expansion and redevelopment of the current Garfield Elementary
<br />School site into a new 700-student middle school.
<br />
<br />WHEREAS, the Planning Commission at its meeting of October 5, 2004, unanimously voted to
<br />approve the vacation of Cohassett Place in order to faciiitate construction of the new 700-student middle
<br />school; and
<br />
<br />WHEREAS, on June 27, 2005, the Board of Revision of Assessments approved vacation of the public
<br />right-of-way of Cohassett Place hereinafter more particularly described in accordance with the provisions of
<br />ARTICLE XVI, SECTIONS 6 and 28 of the SECOND AMENDED CHARTER OF THE cm OF LAKEWOOD.
<br />
<br />WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this
<br />ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible
<br />as set forth i.n ARTICLE III, SECTIONS 10 and 13 Of the SECOND AMENDED CHARTER OF THE cm OF
<br />LAKEWOOD, and that it is necessary to provide fOr the usual daily operation of municipal departments in
<br />that delay could impair the City's abiiity to provide necessary services in a timely manner, now, therefore,
<br />
<br />BE IT ORDAINED BY THE cm OF LAKEWOOD, STATE OF OHIO:

<br />That the following described properties are and the same are hereby

<br />vacated:

<br />Permanent Parcel Number 312-31-058 - property was transferred in 1940 to the Board of
<br />Education and is part of the original Garfield Elementary School property.
<br />
<br />Permanent Parcel Number 312-31-059 - 13114 Detroit Avenue - property was transferred in
<br />1916 to the Board of Education and is part of the original Garfield Elementary School property.
<br />
<br />13027 Hazelwood Avenue. Garfield Elementarv School. Currentlv zoned R2. PP#312-31~030-
<br />And known as being part of Original Rockport Township Section No. 211 and bounded and described
<br />as follows: Beginning on the Southerly line of Hazelwood Avenuel as dedicated by platl recorded in
<br />Volume 66 of Mapsl Page 1 of Cuyahoga County Records, at a point 726.36 feet Easterly (measured
<br />along said Southerly line) from its point of intersection with the ,Easterly line of Nicholson Avenue;
<br />thence Westerly along the said Southerly line of Hazelwood Avenue 40.49 feet; thence Southerly line
<br />on a line at right angles along the said SoutherlyHne of Hazelwood Avenue, 94.82 feet to the
<br />Southerly line of land conveyed to Adam J. and Nellie J. Knopf by Deed dated April 11, 1914 and
<br />recorded in Volume 1566, Page 76 of Cuyahoga County Records; thence Easterly along said Southerly
<br />line of land so conveyed to Adam J. and Nellie Knopf, 40.19 feet; thence Northerly 85.82 feet to the
<br />place of beginning and being further known as Sublot No. 20 in the H. and G. Building Company's
<br />proposed Allotment of part of Original Rockport Township Section No. 211 be the same more or less
<br />but subject to all legal highways.

<br />the Southerly line of land conveyed to John F. Bond and Opal B. Bond by deed dated February IS,
<br />1924 and recorded in Volume 29221 Page 530 of Cuyahoga County Records; Thence Easterly along
<br />the Southerly line of land so conveyed to John F. Bond and Opal B.Bond, about 47 feet to the
<br />Westerly line of land conveyed to the City of Lakewood by deed dated June 15, 1927 and recorded in
<br />Volume 3568, Page 159 of Cuyahoga County Records; Thence Southerly along said Westerly line of
