PLACED ON 1ST READING & REFERJŒD TO THE PUBLIC WORKS COMMITTEE 11/15/04. ORDINANCE NO. 98-04 BY: Corrigan, Demro, Dever, Dunn, FitzGerald, Madigan, Seelie. AN ORDINANCE to authorize the Mayor to enter into an agreement with the Cuyahoga County Board of Commissioners for the improvement of Lake Road (US-6) Bridge No. 204 over Rocky River in the Cities of Rocky River and Lakewood, Ohio. WHEREAS, the City of Lakewood recognizes the need for and proposes the improvement of a portion of public highway described as follows: The seal and patch of the Lake Road (US-6) Bridge No. 204 over Rocky River in the Cities of Rocky River and Lakewood. WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an émergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CTIY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usuai daily operation of municipal departments in that these repairs must be made in a timely manner. Now Therefore, BE IT ORDAINED BY THE COUNCIL OF THE CTIY OF LAKEWOOD, STATE OF OHIO: Section 1. A. CONSENT 1. It is declared to be in the public interest that the consent of the City of Lakewood be and such consent is hereby given to the County and the Ohio Department of Transportation to construct the above desCribed improvement in accordance with plan, specifications and estimates approved by the County. B. COOPERATION 1. That the City of Lakewood wili cooperate with the County and the Ohio Department of Transportation in the seal and patch of the Lake Road (US-6) Bridge No. 204 over Rocky River in the Cities of Rocky River and Lakewood. 2. That the County will arrange for the preparation of construction plans and specifications, Including necessary engineering reports for improvement, under current Cuyahoga County Engineer standards for construction of County roads and bridges. 3. That the County will arrange for the supervision and administration of the construction contract. C. FUNDING 1. That the City of Lakewood hereby agrees to participate with the County in the cost of the improvement by an allocation from the County Motor Vehicle License Tax Fund to pay the County portion of the project.
