<br />/\ <br />~ <br /> <br />PLACED ON 1ST READING & REFERRED TO THE <br />RULES & ORDINANCES COMMITTEE 4/18/05. <br /> <br />PLACED ON 2ND READING 5/2/05. <br /> <br />Ordinance No. 27-05 By: Corrígan, Demro, Dever, Dunn, <br />FitzGerald, Madigan, Seelíe. <br />An Ordinance to repeal Chapter 1317, Motion Pictures and Films, of the Codified <br />Ordinances of the City of Lakewood. <br /> <br />Whereas, the City wishes to attract large-scale development; and <br /> <br />Whereas, in order to compete for and to attract large-scale development, the city <br />must have a competitive fee structure; and <br /> <br />~' <br /> <br />;~ ' <br />Whereas, competitive fee structures will keep the cost of doing busihess in <br />Lakewood equitable. <br /> <br />Whereas, after a comprehensive review of our permit fee structure and an <br />analysis of our neighboring communities fee structures, the Administration is <br />recommending the elimination, lowering and increase of various fees; and <br /> <br />Whereas, these adjustments will resuit in the stimulation and furt)1ering of <br />economic activity, especially in the area of new construction. Now theréfore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That, Chapter 1317, Motion Pictures and Films, of the Codified <br />Ordinances of the City currently reading as follows: <br /> <br />1317.01 DEFINmON. <br />The term "picture machine" when used herein means any machine or device, <br />either permanently located or portable in nature, operated by or with the aid of <br />electricity or any other iIIuminant, and which is designed, intended or used to project <br />upon a screen or other surface, pictorial representations through the use of any type of <br />film, tape or other material or equipment. <br /> <br />1317.02 SCOPE OF APPLICATION. <br />The provisions of this chapter shall apply to theaters, auditoriums, schools, <br />churChes, halls and such other exhibition or meeting rooms to which the public or any <br />segment thereof are admitted to view the showing of any pictorial representations <br />projected from a picture machine as defined herein. <br /> <br />1\317.03 COMPLIANCE WITH LAW. <br />- No picture machine shall be installed, maintained or operated within the City <br />eXcept in conformity with the provisions of this chapter and all other provisions of the <br />Codified Ordinances relating to the instailation and construction of a booti} for the <br />enclosing of a picture machine as well-as the requirements relating to the contents, <br />v~ntilation, doors, electrical installations and signs thereof together with such <br />r¢quirements relating to the location, construction and other safety regulations for <br />theaters, exhibition or meeting halls, auditoriums or other places of ass~mbly. <br /> <br />1317.04 NONCOMBUSTIBLE MAGAZINES AND CONDENSER SHUTIER. <br />All picture machines within which combustible film is used shall tie equipped with <br />noncombustible magazines for receiving and delivering the films during the operation of <br />
