An Ordinance to repeal Chapter 753, Fire and Going Out of Business Sales, of the Cqdified Ordinances of the City of Lakewood. 28-05 Whereas, the City wishes to attract large"scale development; and Whereas, in order to compete for and to attract large-scale development, the city mµst have a competitive fee structure; and Whereas, competitive fee structures will keep the cost of doing business In Lakewood equitable. Whereas, after a comprehensive review of our permit fee structure and an analysis of our neighborjng communities fee structures, the Administration is r!i:Commending the elimination, lowering and increase of various fees; and Whereas, these adjustments will result in the stimulation and furthering of economic activity, especially in the area of new construction. Now therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That, Chapter 753, Fire and Going Out of Business Sales, of the Codified Ordinances of the City currently reading as follows: 753.01 DEFINITIONS. As used in this chapter certain tèrms are defined as follows: (a) "City" means the City of Lakewood, Ohio. (b) "Fire and other altered goods sale" means a sale held out in such a manner as reasonabiy to cause the public to believe that the saie will offer goods damaged or altered by fire, smoke, water or other means. i, @ "Going-outcof-business sale" means a sale held out in such a manner as reasonably to cause the public to believe that upon the disposal of the stock of goods on hand the b,usiness will cease and be discontinued, including, but not limited to, the following sales: adjuster's; adjustment; alteration; assignee's; bankrupt; benefit of administrator's; benefit of creditor's; benefit of trustee's; building coming down; closing; creditor's committee; creditor's; end; executor's; final days; forced out; fOrced out of business; insolvent's; last days; lease expires; liquidation; loss of lease; mortgage sale; receiver's; trustee's; quitting business. (d) "Goods" means any wares, merchandise or other property capable of being the object of a sale regulated hereunder. (e) "Person" means any individual, firm, partnership, association, corporation, company or organization of any kind.
