<br />'! <br />" ) <br /> <br />PLACED ON 1ST RE¡\J)II'IG & REFERREP TO TRE <br />RULES & ORDINANCES COMMITTEE 4/18/05. <br /> <br />PLACED ON 2ND REAPING 5/2/05. <br /> <br />Ordinance No. <br /> <br />By: C· P . <br />orr~gan, ernro, Dever, Dunn, <br />FitzGerald, Madigan, Seelie. <br />An Ordinance to repeal Chapter 753, Fire and Going Out of Business Sales, of the <br />Cqdified Ordinances of the City of Lakewood. <br /> <br />28-05 <br /> <br />Whereas, the City wishes to attract large"scale development; and <br /> <br />Whereas, in order to compete for and to attract large-scale development, the city <br />mµst have a competitive fee structure; and <br /> <br />Whereas, competitive fee structures will keep the cost of doing business In <br />Lakewood equitable. <br /> <br />Whereas, after a comprehensive review of our permit fee structure and an <br />analysis of our neighborjng communities fee structures, the Administration is <br />r!i:Commending the elimination, lowering and increase of various fees; and <br /> <br />Whereas, these adjustments will result in the stimulation and furthering of <br />economic activity, especially in the area of new construction. Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That, Chapter 753, Fire and Going Out of Business Sales, of the <br />Codified Ordinances of the City currently reading as follows: <br /> <br />753.01 DEFINITIONS. <br />As used in this chapter certain tèrms are defined as follows: <br /> <br />(a) "City" means the City of Lakewood, Ohio. <br /> <br />(b) "Fire and other altered goods sale" means a sale held out in such a manner as <br />reasonabiy to cause the public to believe that the saie will offer goods damaged or <br />altered by fire, smoke, water or other means. <br /> <br />i, <br /> <br />@ "Going-outcof-business sale" means a sale held out in such a manner as reasonably <br />to cause the public to believe that upon the disposal of the stock of goods on hand the <br />b,usiness will cease and be discontinued, including, but not limited to, the following <br />sales: adjuster's; adjustment; alteration; assignee's; bankrupt; benefit of <br />administrator's; benefit of creditor's; benefit of trustee's; building coming down; <br />closing; creditor's committee; creditor's; end; executor's; final days; forced out; fOrced <br />out of business; insolvent's; last days; lease expires; liquidation; loss of lease; <br />mortgage sale; receiver's; trustee's; quitting business. <br /> <br />(d) "Goods" means any wares, merchandise or other property capable of being the <br />object of a sale regulated hereunder. <br /> <br />(e) "Person" means any individual, firm, partnership, association, corporation, company <br />or organization of any kind. <br />
