PLACED ON 1ST READING & REFERRED TO THE FINANCE <br /> COMMITTEE 9/6/05. <br /> <br /> ORDINANCE ND. 81-OS BY: Corrigan, Demro, Dever, Dunn, <br /> FitzGerald, Madigan, Seelie <br /> AN EMERGENCY ORDINANCE declaring the repair of the brick surface of Fischer Road <br /> from West 154"' Street to Rocky River Drive in the Cities of Lakewood and Cleveland to be in <br /> the public interest, granting consent to the City of Cleveland to construct the above described. <br /> improvement, in accordance with plans, specifications and estimates as approved by the <br /> Director of Public works for the City of Lakewood, and authorizing the Mayor of the City of <br /> Lakewood to enter into agreements with the City of Cleveland necessary to complete the <br /> planning and construction of this improvement in an amount not to exceed $55,000. <br /> c <br /> WHEREAS, the City of Lakewood, has identified the need for and proposed the <br /> improvement of Fischer Road. as described above; and <br /> WHEREAS, the City OF Cleveland intends to carryout such improvements; and <br /> WHEREAS, it will be more cost effective that the City of Lakewood participate in this <br /> project with the City of Cleveland; and <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br /> determines that this ordinance is an emergency measure, and that this ordinance shall <br /> take effect at the earliest date possible as sef forth in ARTICLE III, SECTONS IO and <br /> 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br /> necessary for the immediate preservation of the public property, health and safety, and <br /> to provide for the usual daily operation of municipal departments in that the City of <br /> Cleveland has requested the City of Lakewood commitment to participate in this project <br /> no later than August 3, 2005. Now Therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> Section 1. That it is declared to be in the public interest that the consent of said City <br /> be and such consent is hereby given to the City of Cleveland to repair the brick surface of <br /> Fischer Road from West 154` Street to Rocky River Dr'sve in the Cities of Lakewood and <br /> Cleveland, in accordance with plans, specifications and estimates as approved by the Director <br /> of Public Works for the City of Lakewood. <br /> Section 2. That the Mayor of the City is hereby empowered and directed on behalf of <br /> the City to enter into agreements with the City of Cleveland necessary to complete the <br /> planning and construction of this improvement in an amount not to exceed $55,000. <br /> Section 3. It is found and determined that ail formal actions of this Council <br /> concerning and relating to the passage of this ordinance were adopted in an open meeting of <br /> this Council, and that ail such deliberation of the Council and of any of its committees that <br /> resulted in such forma! action were in meefings open to the public in compliance with all legal <br /> requirements. <br /> Section 4. That this ordinance is hereby declared to be an emergency <br /> measure necessary for the immediate preservation of the public peace, property, <br /> health, safety and welfare in the City and for the usual daily operation of the Gty for <br /> the reasons set forth and defined in the preamble to this ordinance, and provided it <br /> receives the affirmative vote of at least five (5) of its members elected to Council, this <br /> <br />
