AN EMERGENCY ORDINANCE to authorize the Mayor to make application to the Cuyahoga County Board of Commissioners for approval to use County Motor Vehicle License Tax Funds for the structural steel repairs for Lakewood Road Bridge No. 204 over the Rocky River in the Cities of Rocky River and Lakewood and to enter into an agreement with Cuyahoga County necessary to complete the planning and construction of this improvement. WHEREAS, the City of Lakewood recognizes the need for and proposes the improvement of a portion of public highway described as follows: The structural steel repairs for Lake Road Bridge No. 204 over the Rocky River in the Cities of Rocky River and Lakewood. WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that this legislation is required to permit this project to begin. Now Therefore, BE 1T ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section i. A. CONSENT i. It is declared to be in the public interest that the consent of the City of Lakewood be and such consent is hereby given to the County and the Ohio Department of Transportation to construct the above described improvement in accordance with plan, specifications and estimates approved by the County. B, COOPERATION 1. That the City of Lakewood will cooperate with the County and the Ohio Department of Transportation in the structural steel repairs for Lake Road Bridge No. 204 over the Rocky River in the Cities of Rocky River and Lakewood. 2. That the County will arrange for the preparation of construction plans and specifications, including. necessary engineering reports for improvement, under current Cuyahoga County Engineer standards for construction of County roads and bridges. 3. That the County will arrange for the supervision and administration of the construction contract. C. FUNDING 1. That the City of Lakewood hereby agrees to participate with the County in the wst of the improvement by an allocation from the County Motor Vehicle License Tax Fund to pay the County portion of the project.
