<br />ORDINANCE NO: <br /> <br />65-06 <br /> <br />PLACED ON 1 ST READING & REFERRED TO THE <br />PUBLIC WORKS COMMITTEE 10/Z/06'PLACED ON <br />2ND READING 10/16/06. <br />BY: Antonio, Butler, Deroro, <br />Dever, FitzGerald, Madigan, Seelie. <br /> <br />AN ORDINANCE to take effect immediately provided it received the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law, to establish additional appropriations <br />for current expenses and other expenditures of the City of Lakewood, State of Ohio, for <br />the fiscal year ending December 31, 2006. <br /> <br />WHEREAS, this Council by a vote of at least. five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 <br />of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that this Ordinance <br />is necessary to complete projects planned for the year 2006. Now Therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That Director or Finance is hereby authorized and director to <br />increase/dècrease appropriations in the following funds by the amount stated <br />below: <br /> <br />Generai Fund <br /> <br />$133,750 <br /> <br />Section 2. That thè Director of Finance is hereby authorized to draw <br />checks upon the City depositories for the amounts appropriated in this ordinance <br />whenever claims are presented, properly approved by the head of the <br />department for which the indebtedness is incurred, providing the President of <br />Council or his/her designees shall approve ali claims of the City Council. <br /> <br />Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Councii and of any of its committees, that resulted in <br />such formal actions, were in meetings open to the public in compliance with all <br />legal requirements. <br /> <br />Section 4. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, <br />property, health, safety and weifare in the City and for the usual daily operation <br />of the City for the reasons set forth and defined in the preamble to this <br />ordinance, and provided it receives the affirmative vote of at least five (5) of its <br />members ~Iected to Council, this ordinance shall take effect and .be in force <br />immediately .upon its adoption by the Council and approval by the Mayor <br />otherwise, it shall take effect and be in force after the earliest period allowed by <br />iaw. <br /> <br />AdoPted:)1~ht....
