<br />PLACED on 1ST READING & REFERRED TO THE <br />PUBLIC WORKS CONNITTEE 10/16/06 <br /> <br />PLACED ON 2ND READING AT SPECIAL MEETING <br />OF COUNCIL 10/24/06. <br /> <br />ORDINANCE NO. <br /> <br />68-06 <br /> <br />BY: <br /> <br />Antonio, Butler, Demro, Dever, <br />FitzGerald, Madigan, Seelie. <br /> <br />AN ORDINANCE to take effect immediately provided it received the affirmative vote of <br />at least five (5) members elected to Council otherwise, it shall take effect and be in force <br />after the earliest period allowed. by law requesting the cooperation of the County of <br />Cuyahoga by its Board of County Commissioners. <br /> <br />WHEREAS, the City of Lakewood has recognized the need for and proposes the <br />improvement of a portion of public highway which is described as follows: <br /> <br />WHEREAS, this project is part of a larger project which is the installation of climbing <br />systems for the Detroit Road Bridge No. 66 over the Rocky River & Clifton/Westlake Bridge <br />No. 204 over the Rocky River and Yacht Club Drive in the Cities of Lakewood and Rocky <br />River; and <br /> <br />WHEREAS, this Council by a vote of at least five members elected thereto determines <br />that this ordinance is an emergency measure, and that this ordinance shall take effect at the <br />earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 12 of the SECOND <br />AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary to provide for the <br />usual daily operation of the City in that . Now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. <br /> <br />A. CONSENT <br />1. It is declared to be in the public interest that the consent of the City of <br />Lakewood be and such consent is hereby given to the County and the <br />Ohio Department of Transportation to construct the above described <br />improvement in accordance with plan, specifications and estimates <br />ápproved by the County. <br /> <br />B. COOPERATION <br />1. That the City of Lakewood wiil cooperate with the County and the Ohio <br />Department of Transportation in the installation of climbing systems for <br />the Detroit Road Bridge No. 66 over the Rocky River & Clifton/Westlake <br />Bridge No. 204 over the Rocky River and Yacht Club Drive. <br />2. That the County wili arrange for the preparation of construction plans <br />and specifications, including necessary engineering reports for <br />improvement, under current Cuyahoga County Engineer standards for <br />construction of County roads and bridges. <br />3. That the County wiil arrange for the supervision and administration of <br />the construction contract. <br /> <br />C. FUNDING <br />1. That the City of Lakewood hereby agrees to participate with the County <br />in the cost of the improvement by an allocation from the County Motor <br />Vehicle License Tax Fund to pay the County portion of the project. <br /> <br />D. MAINTENANCE <br />
