PLACED ON 1ST RE~DING & REFERRED TO THE RULES & ORDINANCES COMMITTEE 11/20/06. SECOND READING 12/4/06. ORDINANCE NO, 83-06 FitzGerald, Madigan, Seelie. AN ORDINANCE to create a new section within Chapter 144, Civil Service Commission,,of the Codified Ordinances of the City Of LakeWood to set out the procedure for temporary appointments, WHEREAS, this ordinance is necessary in that any Rules and Regulations of the Lakewood Civil Service Commission which differ from the Ohio Revised Code must be enacted by ordinance; and WHEREAS, based on the experience of the Civil Service Commission and their extensive review of the Rules and Regulations, the Commission recommends that the procedure for temporary appointments be reflected as described in the proposed ordinance. Now, therefore, BE 1/ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That a new Section within ChaPter 144, Civil Service Commission, of the Codified Ordinances of the City of Lakewood is hereby created to read as follows: 144,XX TEMPORARY APPOINTMENTS (a) In the case of sickness or disability of a permanent employee, unusual work load or other emergency, an appointing authority may request a temporary appointment. (b) Upon request for such temporary appointment, the Commission may follow the normal procedures for appointment or take such other action as the Commission deems appropriate under the circumstances, (c) Failure of any person on an eligible list to accept a temporary appointment shall not affect his/her standing on the eligible list. If the person accepts the temporary appointment, it shall not be considered part of a probationary period in case of subsequent appointment. (d) No such temporary appointment shall last longer than six months or the duration of the emergency, whichever is shorter. (e) Any change in the nature Of the employment of the temporary emp]oye~ or an increase in salary shall immediately terminate such temporary appointment, unless the Commission is previously notified and approves of such changes. (0 Subsections (a) through (e) hereof are Specifically intended to supersede State Code provisions on the procedure for temporary appointments. Section 2. It is found and determined that all formal actions of this Council concernin¢ and relating to the passage of this ordinance were adopted in an open meeting off this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings
