ORDINANCE NO 15-07 BY' A~tonio, Bntler, Demro, Dever, <br /> FitzGerald, Madigan~ ~ ' <br />AN ORDINANCE to take elect immediately provided it receives the affirm@tive vote of at <br />least five (5) members e~ected to Counci~ otheP~vise~ it shall take elect and be in force after the <br />earliest period allowed by law, authorizing the Mayor of the City of Lakewood, Ohio, to enter <br />into an Agreement with the~ Local 1043 and Ohio Council 8, American Pederation of State, <br />County and Municipal Employees for a three year period commencing ]anua~ lr 2007. <br /> <br /> WHEREAS, the Administration has conducted extensive negotiations with Loca~ 1043 and <br />Ohio Council 8, American Federation of State, County and Municipal Employees as the <br />bargain!ng representative for ceRain employees of the Public Works Depa~ment; and <br /> <br /> WHEREAS, such negotiations have provided a Tentative Agreement be~veen the parties <br />for the years 2007, 2008, and 2009; and <br /> <br /> WHEREAS, Counci~ and the Administration here reviewed such proposal and do desire to <br />ratify and adopt such agreement; and <br /> <br /> WHEREAS, this Council by a vote of at least'five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as set forth in ARTICLE Iii, SBCTONS 10 and 13 of the <br />SECOND AMENDED CHARTER OF THE CItY OF LAKh~VOOD, and that it provides for the usual <br />daily operation of municipal departments in that employees of the Department of Public Works <br />have been 'receiving bbnefits of employment under thei~ previous ~ontJract. Now, ther&fore <br /> <br />BE 1~- ORDAINED BY THE Ci-TY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the lVlayor be and is hereby authori2ed and directed to enter into an <br />Agreement, for a three year period commehcing ]ahuary 1/2007, with Lo~al 1043 and Ohio <br />Council 8. American Federation of State, County and iViunicioat E~l~loyee~, ~n behalf of certain <br />employees of the Public Works Department; the Agreement, m~de a aar[ hereof as though fully <br />rewritten hereir is on file in [ne office of the Director of Law. <br /> <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of tbi~ Ordinance were passed in an open meeting of <br />this Council and that all deliberations of this Council ano any of its committees that resulted in <br />SUCh actions were in meetings' olden to the public and in compliance with legit requirements, <br /> <br /> Section 3.
