PLACED ON iST READING & REEERRED TO ~HE PUBLIC SAFETY CMTE 2/5/07. 2ND READING 2/20/07. ORDINANCE NO: 16-07 BY: Butler, Demro, Dever, FitzGerald, Madigan, Seetie. AN ORDINANCE to take effect immediately provided it received the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the eadiest period allowed by law, to authorize the Mayor to enter into an agreement between the Cities of Bay village, Lakewood, Rocky River, Fairview Park, North Olmsted, Westlake (Westshore Council of Government Communities) and the City of Cleveland for the interchange of Bomb Squad services and/or SWAT services. WHEREAS, the CRies of Bay Village, Lakewood, Rocky River, Fairview Park and North Olmsted and Westlake have formed the Westshore Council of Governments which has established the Westshore Enforcement Bureau (WEB); and WHEREAS, Ohio Revised Code §737.04 provides authority for municipalities to contract for the interchange of police services; and WHEREAS, in order to obtain additional police protection and reduce crime, it is the desire of the parties to this agreement to provide for and join in providing for mutual assistance and the interchange of their respective personnel and equipment; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this Ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE ITT, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE ci-rY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public properly, health and safety, and to provide for the usual daily operation of munidpal departments in that this agreement is necessary to immediately provide for mutual aid between WEB Communities and the City of Cleveland. Now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That the Mayor be authorized and directed to execute the Agreement between the Cities of Bay Village, Lakewood, Rocky River, Cleveland, Fairview Park, North Olmsted, and Westlake, for the Interchange of Bomb Squad Services and/or SWAT Unit Services attached hereto, marked Exhibit "A" and made a part hereof, with any minor revisions and modifications desired by the other member Cities of the Westshore Coundl of Governments consistent with mis ordinance as may be approved by the Director of Law. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 3. That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property~ health, safety and welfare in the City and for the usual dally operation of the City for
