ORDINANCE NO. 34-07 BY: An~onlo, Butler, Demro, Dever, FitzGerald, Madigan, AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, to submit to the electorate of the City of Lakewood an Amendment to the Second Amended Charter of the City of Lakewood. WHEREAs, pursuant to Article XVIII, Section 9 of the Ohio Constitution petitions have been presented to LakeWood City Council requesting an amendment to the Second Amended Charter of the City of Lakewood; and WHEREAS, Lakewood City Council is required by the Ohio Constitution to submit the question of whether to amend the Charter to the electors; and WHEREAS, Lakewood City Council has no discretion to change or Otherwise amend the proposed Charter Amendment presented by petition; and WHEREAS, the Clerk of Council, through the Cuyahoga County Board of Elections, has verified that the petitions contain a sufficient number of signatures; and WHEREAS, this Council by a vote of at least five (S) member~ elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SEC'TONS l0 and 13 of the SECOND AMENDED CHARTER OF THE cITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that this item must be submitted to a vote of the electorate within 120 days of passage. Now, therefore, BE IFf' ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO, Section 1. That the question of an Amendment to the Second Amended Charter of the City of Lakewood shall be submitted to the voters at the election to be held May 8f 2007. Section 2. That the que~ion shall be submitted to the voters in the form presented by the petitions below, which is as follows: ORDINANCE NO. -0S AN ORDINANCE FOR THE SUBMISSION TO THE ELECTORATE OF AN AMENDMENT TO THE MUNICIPAL CHARTER RELATIVE TO ARTICLE XXIII, GENERAL PROVISIONS, TO PERMIT EMPLOYEES OF THE LAKEWOOD BOARD OF EDUCATION TO SEEK PUBLIC OFFICE IN THE C1TY OF LAKEWOOD. WHEREAS, pursuant to Article XXIII, Section 6 of the Second Amended Charter of the City of Lakewood arid Article )(VIII, Section 9 of the Ohio Constitution, petitions have been presented to Lakewood City Council requesting an amendment to the Second Amended Charter of the City of Lakewood; and
