ORDINANCE NO. <br /> <br />34-07 <br /> <br />BY: An~onlo, Butler, Demro, <br /> Dever, FitzGerald, Madigan, <br /> <br /> AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law, to submit to the electorate of the <br />City of Lakewood an Amendment to the Second Amended Charter of the City of <br />Lakewood. <br /> <br /> WHEREAs, pursuant to Article XVIII, Section 9 of the Ohio Constitution petitions <br />have been presented to LakeWood City Council requesting an amendment to the <br />Second Amended Charter of the City of Lakewood; and <br /> <br /> WHEREAS, Lakewood City Council is required by the Ohio Constitution to submit <br />the question of whether to amend the Charter to the electors; and <br /> <br /> WHEREAS, Lakewood City Council has no discretion to change or Otherwise <br />amend the proposed Charter Amendment presented by petition; and <br /> <br /> WHEREAS, the Clerk of Council, through the Cuyahoga County Board of <br />Elections, has verified that the petitions contain a sufficient number of signatures; and <br /> <br /> WHEREAS, this Council by a vote of at least five (S) member~ elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SEC'TONS l0 and <br />13 of the SECOND AMENDED CHARTER OF THE cITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, <br />and to provide for the usual daily operation of municipal departments in that this item <br />must be submitted to a vote of the electorate within 120 days of passage. Now, <br />therefore, <br /> <br /> BE IFf' ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br />OHIO, <br /> <br /> Section 1. That the question of an Amendment to the Second Amended Charter <br />of the City of Lakewood shall be submitted to the voters at the election to be held May <br />8f 2007. <br /> <br /> Section 2. That the que~ion shall be submitted to the voters in the form <br />presented by the petitions below, which is as follows: <br /> <br />ORDINANCE NO. -0S <br /> <br />AN ORDINANCE FOR THE SUBMISSION TO THE ELECTORATE OF AN <br />AMENDMENT TO THE MUNICIPAL CHARTER RELATIVE TO ARTICLE XXIII, <br />GENERAL PROVISIONS, TO PERMIT EMPLOYEES OF THE LAKEWOOD <br />BOARD OF EDUCATION TO SEEK PUBLIC OFFICE IN THE C1TY OF <br />LAKEWOOD. <br /> <br />WHEREAS, pursuant to Article XXIII, Section 6 of the Second Amended <br />Charter of the City of Lakewood arid Article )(VIII, Section 9 of the Ohio <br />Constitution, petitions have been presented to Lakewood City Council <br />requesting an amendment to the Second Amended Charter of the City of <br />Lakewood; and <br /> <br /> <br />
