AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least fie (5) members elected to Coundl otherwise, it shall take effect and be in force after the earliest period allowed by law, authorizing the Director of Einance to sell, through public intemet auctions, various obsolete, surplus and non-functioning City vehicles,~ materials and/or equipment as authorized by Ohio Revised Code §721.55(D). WHEREAS, often specialized equipment's value is not realized through sale at the City's traditiona! auctions; and WHEREAS, vehicles that have been forfeited to the Division of Police sit for months in anticipation of the City's semi-annual auctions creating storage problems and sometimes depreciating in value due to problems realized from long term storage; and WHEREAS, an on-line auction should increase the number of bids for certain specialized materials, equipment or vehicles thereby increasing the sale pdce of that item; and WHEREAS, this Council byan affirmative vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it provides for the usual dally operation of municipal departments in that it is in the best interest of the City to sell obsolete equipment in a timely manner due to lack of physical storage at City Hall and delivery of new equipment. Now, therefore, 8E 1m ORDAINED BY THE C1TY OF LAKEWOOD, STA]~E OF OHIO: Section 1. That the Director of Finance be and he is hereby authorized and directed to sell, through public intemet auctions, on an as needed basis various obsolete, surplus and non-functioning City vehicles, materials and/or equipment. Section 2. The Director of Finance shall engage a representative or representatives to conduct said intemet auctions. Such representatives shall hold bidding for each item open for a pedod of not less than fifteen (15) calendar days. All intemet auction sales shall be final and all items shall be sold as is. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements. Section 4. This ordinance is hereby declared to be an emergency measure necessary fOr the daily operation of municipal departments in the City for the reasons set forth in the preambl~ to this ordinance, and provided it
