PLACED ON 1ST READING & REFERRED TO <br />THE PUBLIC WORKS COMMITTEE 3/19/07. <br /> <br />PLACED ON 2ND READING 4/2/07. <br /> <br />ORDINANCE NO. 38-07 BY: Antonio~ Butler, Demro, <br /> Dever, FitzGeraid, Madigan. <br /> <br /> AN ORDINANCE to take effect immediately provided it receives the <br />affirmative vote of at least fie (5) members elected to Coundl otherwise, it shall <br />take effect and be in force after the earliest period allowed by law, authorizing <br />the Director of Einance to sell, through public intemet auctions, various obsolete, <br />surplus and non-functioning City vehicles,~ materials and/or equipment as <br />authorized by Ohio Revised Code §721.55(D). <br /> <br /> WHEREAS, often specialized equipment's value is not realized through sale <br />at the City's traditiona! auctions; and <br /> <br /> WHEREAS, vehicles that have been forfeited to the Division of Police sit <br />for months in anticipation of the City's semi-annual auctions creating storage <br />problems and sometimes depreciating in value due to problems realized from <br />long term storage; and <br /> <br /> WHEREAS, an on-line auction should increase the number of bids for <br />certain specialized materials, equipment or vehicles thereby increasing the sale <br />pdce of that item; and <br /> <br /> WHEREAS, this Council byan affirmative vote of at least five (5) members <br />elected thereto determines that this ordinance is an emergency measure, and <br />that this ordinance shall take effect at the earliest date possible as set forth in <br />ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE <br />CITY OF LAKEWOOD, and that it provides for the usual dally operation of <br />municipal departments in that it is in the best interest of the City to sell obsolete <br />equipment in a timely manner due to lack of physical storage at City Hall and <br />delivery of new equipment. Now, therefore, <br /> <br />8E 1m ORDAINED BY THE C1TY OF LAKEWOOD, STA]~E OF OHIO: <br /> <br /> Section 1. That the Director of Finance be and he is hereby authorized <br />and directed to sell, through public intemet auctions, on an as needed basis <br />various obsolete, surplus and non-functioning City vehicles, materials and/or <br />equipment. <br /> <br /> Section 2. The Director of Finance shall engage a representative or <br />representatives to conduct said intemet auctions. Such representatives shall <br />hold bidding for each item open for a pedod of not less than fifteen (15) <br />calendar days. All intemet auction sales shall be final and all items shall be sold <br />as is. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in <br />an open meeting of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal action, were in <br />meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 4. This ordinance is hereby declared to be an emergency <br />measure necessary fOr the daily operation of municipal departments in the City <br />for the reasons set forth in the preambl~ to this ordinance, and provided it <br /> <br /> <br />
