ORDINANCE NO. 44~07 <br /> <br />PLEASE SUBSTITUTE FOR ORDINANCE NO. <br />44-07 PLACED ON 1ST READING & REFERRED TO <br />TH~ RULES & ORDINANCES COMMITTEE 4/2/07, <br />2ND READING 4/16/07. <br /> <br />BY: Antonio, Butler, Demro, Dever, <br /> FitzGerald, Madigan, Seelie. <br /> <br /> AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect <br />and be in force after the earliest period allowed by law, to add subsection (e) <br />to Section 1323.01 of the Lakewood Codified Ordinances to reinforce the obligation of <br />Lakewood construction contractors:to employ only those who have the legal right to <br />work in the United States of America <br /> <br /> WHEREAS, the City has an interest in ensuring that the labor and immigration <br />laws of the United States be obeyed by prohibiting construction contractors and <br />subcontractors in the City of Lakewood from employing undocumented workers; and the <br />City's existing registration requirements for construction contractors provides an <br />opportunity to emphasize that responsibility; and <br /> <br /> WHEREAS, this Council by a vote of at least five members elected thereto <br />determines this ordinance is an emergency measure, and that this ordinance shall take <br />effect at the earliest date possible as set forth in ARTICLE Ill;SECTIONS 10 and 13 of <br />the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary to provide for the usual daily operation of the City in that the City must <br />prevent unauthorized employment of undocumented workers. Now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1 That a new subsection (e) be added to Section 1323.01 Registration <br />Requirement of Chapter 1323 Registration of Contractors of the Codified <br />Ordinances of the City of Lakewood; to read as follows: <br /> <br />(e) In accordance with laws of the United States that require employers to <br /> obtain I-9 or other documentation to show that only U.S. citizens or <br /> other eligible workers are employed, individuals or entities that perform <br /> any construction work under this Section shall not employ or <br /> subcontract to any individual, sole proprietorship, or other entity, <br /> where the individual, the owner, or owners do not have the <br /> legal right to work in the United States. Whoever violates this <br /> subsection of this Chapter shall be guilty of a misdemeanor of the first <br /> degree. <br /> <br />Seution 2. It is found and determihed that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberations of the Council and of any <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements <br /> <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof, and provided it receives <br />the affirmative vote of at least five (5) of its members elected to Council, this <br /> <br /> <br />
