ORDINANCE NO. 44~07 PLEASE SUBSTITUTE FOR ORDINANCE NO. 44-07 PLACED ON 1ST READING & REFERRED TO TH~ RULES & ORDINANCES COMMITTEE 4/2/07, 2ND READING 4/16/07. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, to add subsection (e) to Section 1323.01 of the Lakewood Codified Ordinances to reinforce the obligation of Lakewood construction contractors:to employ only those who have the legal right to work in the United States of America WHEREAS, the City has an interest in ensuring that the labor and immigration laws of the United States be obeyed by prohibiting construction contractors and subcontractors in the City of Lakewood from employing undocumented workers; and the City's existing registration requirements for construction contractors provides an opportunity to emphasize that responsibility; and WHEREAS, this Council by a vote of at least five members elected thereto determines this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE Ill;SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary to provide for the usual daily operation of the City in that the City must prevent unauthorized employment of undocumented workers. Now therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1 That a new subsection (e) be added to Section 1323.01 Registration Requirement of Chapter 1323 Registration of Contractors of the Codified Ordinances of the City of Lakewood; to read as follows: (e) In accordance with laws of the United States that require employers to obtain I-9 or other documentation to show that only U.S. citizens or other eligible workers are employed, individuals or entities that perform any construction work under this Section shall not employ or subcontract to any individual, sole proprietorship, or other entity, where the individual, the owner, or owners do not have the legal right to work in the United States. Whoever violates this subsection of this Chapter shall be guilty of a misdemeanor of the first degree. Seution 2. It is found and determihed that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of the Council and of any committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements Section 3.
