ORDINANCE NO, 52-07 <br /> <br />BY; Antonio, Butler, Demro, Dever, <br /> FitzGerald, Madigan, Seelie. <br /> <br /> AN ORDINANCE to take effect immediately provided it received the affirmative vote of at least <br />five (5) members elected to Council otherwise, it shall take effect and be in force afLer the earliest <br />period allowed by law, authorizing the City of Lakewood to pick up the statutorily required <br />contribution to the Public Employees Retirement System of Ohio for the employees of the City <br />pursuant to Internal Revenue Code Section 414 (h) (2). <br /> <br /> WHEREAS, pursuant to federal and Ohio laws, the employees of the Qty of Lakewood could <br />defer the federal and state income taxes on a portion of their wages or salaries if the City of <br />Lakewood would "pick up" (assume and pay) the statutorily required contribution by such elected <br />officials and covered employees to the Public Employees Systems of Ohio; and <br /> <br /> WHEREAS, the City of Lakewood will not incur any additional costs in the deferment of federal <br />and state income taxes, <br /> <br /> WHEREAS, this Council by a vote of at least five members elected thereto determines that this <br />ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date <br />possible as set forth in ARTICLE III, SECTIONS 10 and 12 of the SECOND AMENDED CHARTER OF <br />THE CI-P( OF LAKEWOOD, and that it is necessary to provide for the usual daily operation of the City <br />in that in the interest of public, service, welfare and safety, it is necessary to adjust the compensation <br />of employees. Now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. Effective January 1, 2007 the full amount of the statutority required <br />contributions to the Public Employees Retirement System (PERS) of Ohio shall be withheld from the <br />gross pay of each person within any of the classes established in Section 2 herein and shall be <br />"picked up" (assumed and paid to the Public Employees Retirement System of Ohio) by the City of <br />Lakewood. This "pick up" by the City of Lakewood is, and shall be designated as, public employee <br />contributions and shall be in lieu of contributions to the Public Employees Retirement System of Ohio <br />by each person within any of the classes established in Section 2 herein. No person subject to this <br />"pick up" shall have the option of choosing to receive the statutorily required contribution to the <br />Public Employees Retirement System Of Ohio directly instead of having it "picked up" by the City of <br />Lakewood or of being excluded from the "pick up." <br /> <br /> The City of Lakewood shall, in reporting and making remittance to the Public Employees <br />Retirement System of Ohio report that the public employees contribution for each person subject to <br />this "pick up" has been made as provided by the statute. <br /> <br /> Section 2. The "pick up" by the City of Lakewood provided by this ordinance shall apply to <br />all persons that; <br /> Are employees of the City of Lakewood who are or become contributing <br /> members of the Public Employees Retirement System of Ohio <br /> <br /> Section 3. The City's method of payment of salary to employees who are participants in <br />PERS is hereby modified as follows, in order to provide for a salary reduction pick-up of 100% of the <br />employee contributions to PERS. <br /> <br /> <br />
