AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in fore after the eadiest pedod allowed by law, authorizing the City of Lakewood to establish a Land ReutilizaUon Program as provided in Chapter 5722 of the Ohio Revised Code. WHEREAS, Chapter 5722 of the Ohio Revises Code perm~ municipal corporations to establish land reutilization programs; and WHEREAS, it is in the best interest of the City to establish a land reutilization program; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE crrY OF LAKEWOOD, and that it provides for the usual daily operation of municipal departments in that correction officers within the Division of Police have been receiving benefits of employment under their previous contract. Now, therefore BE EF ORDAINED BY THE CITY OF LAKEWOOD~ STATE OF OHIO: Section 1. That the City of Lakewood hereby declares that there exists sufficient and substantial nonproductive land within its boundaries which is of such nature and extent as to necessitate the implementation of a Land Reutilization Program to foster either the return of such nonproductive land to tax revenue generating status or the devotion thereof to public use. Section 2. That the City of Lakewood hereby adopts and implements the procedures set forth in Chapter 5722 oftbe Ohio Revised Code. Section 3. That the Department of Planning and Development shall administer the Land Reutilization Program. Section 4. That the Director of Planning and Development shall implement policies and procedures, as approved by the Director of Law, that are consistent with this Ordinance and Chapter 5722 of the Ohio Revised Code for the disposition of Land held in the City's Land ReuUlization Program (Land Bank). Section 5. That the Clerk of Council is hereby directed to send certified copies of this Ordinance to the County Auditor, County Treasurer, and County Prosecutor as provided in Section 5722.02 of the Ohio Revised Code. Section 5. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Coundl, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meeUngs open to the public in compliance with all legal requirements.
