ORDINANCE <br /> <br />57-07 <br /> <br /> AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and be <br />in force affer the eadies[ period allowed by law, to add Chapter 717 of the Lakewood <br />Codified Ordinances to provide for the reasonable regulation and placement of portable <br />storage containers <br /> <br /> WHEREAS, in the interest of the public health, safety, and welfare, the <br />City Council of Lakewood has considered the need for reasonable regulations of <br />the outdoor portable storage containers (also known under tradenames such as <br />"PODS", "ReloCubes% or "SIMcontainers"), in order to maintain the esthetics of <br />the City's residential neighborhoods and prevent unsightly or lengthy placements <br />or misuse; and <br /> <br /> WHEREAS, this Council by a vote of at least five members elected thereto <br />determines this ordinance is an emergency measgre, and that this ordinance shall take <br />effect at the eadie~t date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of <br />the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary to provide,for the usual daily operation of the City in that the City must assure <br />the reasonable use of portable storage containers to preserve the quality of the City's <br />neighborhood Now therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1 That a new Chapter 717 be added to the B'usiness Regulation Code, Part <br /> Seven, of the Codified Ordinance~ of the City of Lakewood, to read as follows' <br /> <br />"717.01 TITLE, PURPOSE, AND OBJECTIVES <br /> a) Title. This chapter shall be known and may be cited as the "Lakewood <br />Portable Storage Container Ordinance" <br /> b) Purposeand Objectives. Itisthe purpose ofthis chapter and the policy <br />of the City to establish standards for the licensing, regulation and control of portable <br />storage containers and the objectives of this chapter are to prevent safety and fire <br />hazards, disruption of pedestrian or vehicular traffic, and disorderly or unsightly <br />temporary structures within the City <br /> <br />717,02 CONSTRUCTION AND SEVERABILITY <br /> a) Coestrucdon. This chapter shall be liberally construed and applied to <br />promote its purpose and objectives. <br /> b) Severability. If any provision of this chapter or fhe application thereof <br />to any person or circumstance is held invalid or unconstitutiona~ by any court of <br />competent jurisdiction, such provisioe shall be deemed a separate, distinct and <br />independent provision, and neither the remainder of this chapter nor the application of <br />such provision to other persens or circumstances shall be affected thereby <br /> <br />717.03 DEFINITIONS <br /> The term "podab[e storage container" shall be defined as a t¢ansportable, fully- <br />enclosed, box-like container that is ti) designed for temporary storage of personal <br />property household items, wares, and building materials or merchandise, (ii) typically <br />rented to owners or occupants of property for their temporary use, and (iii) delivered and <br />removed by truc~,. Such containers are uniquely designed for their ease of loading to <br />and from a transport vehicle <br /> <br />717.04 PORTABLE STORAGE BUSINESS LICENSE REQUIRED. <br /> No person shatl place a portable storage container in the City without <br />having first obtained a license therefor as provided ie this chapter, which license shall be <br />designated as a "portable storage business license" <br /> <br /> <br />
