<br />ORDINANCE NO. <br /> <br />65-07 <br /> <br />PLACED ON 1ST READING & REFERRED TO <br />THE HOUSING COMMITTEE 7/16/07. <br />& PUBLIC SAFETY CMTE 7/16/07. <br />PLACED ON2ND READING 9/4/07. <br />BY: Antonio, Butler, Demro, <br />Dever, FitzGerald, Madigan, See lie. <br /> <br />AN ORDINANCE to create a new Section 1501.15, Maximum Occupancy loads, <br />of the Codified Ordinances of the City of Lakewood to create a violation for permitting <br />occupancy load limits to be exceeded. <br /> <br />WHEREAS, the Lakewood Zoning Code and the Ohio Basic Building Code <br />establish occupancy limits for certain businesses; and <br /> <br />WHEREAS, currently only the building department has the authority to enforce <br />occupancy limits; and <br /> <br />WHEREAS, overcrowding creates life threatening hazards in the event of a fire or <br />other emergency requiring evacuation; and <br /> <br />WHEREAS, the Fire Marshall is often involved in these emergencies and can <br />inspect during hours that most business with occupancy load limits are often in violation <br />of occupancy limits. Now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That a new Section 1501.15, Maximum Occupancy Loads, of the <br />Codified Ordinances of the Qty of Lakewood shall be enacted to read as follows: <br /> <br />No person having ownership or control of a place of assembly shall permit <br />the occ~ancy load, as established by the Lakewood Zoning Code and/or the Ohio Bask. <br />'Buiièi¡;¡¡gCode from being exCeeded., lei;'," <br /> <br />""". <br /> <br />Section 2.
