Antonio, Bullock, Butler, ORDINANCE NO: 43-08 By:Dever, Madigan, Powers, Summers. (Please substitute for 43-08, 1st reading 3/17/08, 2nd reading 4/7/08, referred from Committee of the Whole 4/17/08) AN ORDINANCE to amend Ordinance 91-95, the Zonina Code of the Codified Ordinances of the City of Lakewood. WHEREAS, the amendments to the Zoning Code promotes the development of and protects existing residential uses found throughout the City thereby protecting property values; and WHEREAS, the amendments to the Zoning Code encourages the orderly development and retention of commercial uses in a manner consistent with the Community Vision. NOW THEREFORE BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the existing Section 1103.02 of the Codified Ordinances of the City of Lakewood, now reading respectively as follows: 1103.02 DEFINITIONS The foilowing terms and phrases shail have, for purposes of the Code, the meanings as set forth in this section. (bbb) ROOMING UNIT means one (1) or more living and/or sleeping rooms arranged contiguously and being accessible through a single interior entrance, such rooms have NO cooking or sanitary facilities. (ccc) ROOMING HOUSE means a building housing two (2) or more rooming units, wherein the occupants of said rooming units have access to communal sanitary facilities but do not benefit from the cooking facilities within the structure. (ddd) SIMILAR USE means a use not otherwise described in this Code found by the Commission to be substantially similar to a permitted use or a conditionally permitted use, pursuant to Section 1173.03. (eee) SCHOOL means a publicly or privately owned facility providing full- or part-time instruction and training; "school" shall include elementary, junior high, and high schools, college and trade schools, and studios providing instruction (e.g.: craft, dance, karate). (fff) STOCK IN TRADE means the individual items displayed in areas open to the public and offered for sale or rental in an establishment. (ggg) STORY means that portion of a building included between the surface of any floor and the surface of the floor next above it, or if there be no floor next above, then the space between any floor and the ceiling next above, not including a cellar. (hhh) STREET means a properly dedicated public way, which affords the principal means of access to abutting properties. r (iii) STRUCTURE means anything constructed or erected, the use of which requires either location on the ground or attachment to another structure located on the
