PLACED ON 1ST READING & REFERRED T0~ THF~ II~E~ILTH & HL9MAN <br />SERVICES COMMITTEE 7/Z/08. <br />ORDINANCE NO. 72-08 ` BY' Antonio, Bullock, Butler, <br />Dever, Madigan, Powes, Summers. <br />A ORDINANCE to take effect immediately provided it receives the <br />affirmative vote of at least five (5) members elected to Council otherwise, it shall take <br />effect and be in force after the earliest period allowed by law, authorizing and directing <br />the Mayor or his designee, on behalf of the City, to enter into an Agreement with the <br />Western Reserve Area Agency on Aging to accept and expend PASSPORT Program <br />funds for the fiscal period covering July 1, 2008 through June 30, 2010 and ratifying any <br />and all prior agreements to accept and expend funds for this project. <br />WHEREAS, these funds will permit the City to provide additional services <br />to residents without increasing the burden on general fund dollars; and <br />WHEREAS, the PASSPORT Program is designed to provide <br />transportation, home delivered meals, personal care, homemaker service and social <br />work counseling to residents over the age of 60 to who might otherwise require <br />placement in a nursing facility; and <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this ordinance is an emergency measure, and that this <br />ordinance shall take effect at the earliest date possible as set forth. in ARTICLE III, <br />SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the usual daily operation of municipal <br />departments in that the Agreement for the current program year begins July 1, 2008. <br />Now Therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That the Mayor or his designee, on behalf of the City, is hereby <br />authorized to enter into an Agreement with the Western Reserve Area Agency on Aging <br />to accept and expend funds as are eligible for reimbursement through the PASSPORT <br />Program for the fiscal period covering July 1, 2008 through June 30, 2010 and ratifying <br />any and all prior agreements to accept and expend funds for this project. <br />Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in an <br />open meeting of this council, and that all such deliberations of this Council and any of <br />its committees that resulted in such formal action, were in meetings open to the public, <br />in compliance with all legal requirements. <br />Section 3. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual daily operation of the City for the <br />reasons set forth and defined in the preamble to this ordinance, and provided it <br />
