ORDINANCE NO. 99-08 BY: Antonio, Bullock, Butler, Dever, Madigan, Powers, Summers. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, repealing Lakewood Codified Ordinance §509.14, Criminal Activity Nuisance. WHEREAS, new Chapter 510, Nuisance Abatement has been proposed simultaneously with this legislation; and WHEREAS, for organizational purposes, this section should be moved to its own Chapter within the Codified Ordinances of the City of Lakewood; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that changes need to be made to the existing Criminal Nuisance Ordinance to ensure the enforceability of this provision. Now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: Section 1. That Lakewood Codified Ordinance §509.14, Criminal Activity Nuisance, currently reading as follows: 509.14 CRIMINAL ACTIVITY NUISANCES. (a) The following activities occurring on residential or commercial properly, and engaged in by an owner, occupant or invitee of the owner, occupant or person m charge of commercial or residential properly (mcluding individual apartment and condommwm units), are hereby declared to be public nuisances: (1) Any animal violations under Sections 505.02 (dogs running at large), 505.13, 505.15 and 505.20 (animal noise, excrement and biting), 505.18 or Chapter 506 (dangerous or vicious animals) 505.07 (killing or inlunng animals) 505.09 (cruelty to animals) of the Codified Ordinances; (2) f n disorderly conduct, disturbance of the peace or other violation of Chapter 509 of the Codified Ordinances;
