ORDINANCE N0. 29-09 BY: Antonio, sullock, sutler, Dever, Madigan, Powers, Summers. AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, authorizing the Director of Public Works to enter into a Public Private Partnership Agreement with The Great Lakes Construction Company in order to facilitate the replacement of two engines in two Caterpillar bulldozers that will reduce emissions with grant monies awarded by the Ohio Department of Development, Diesel Emissions Reduction Grant Program. WHEREAS, private companies are eligible for these grant dollars only where they are sponsored by a public entity; and WHEREAS, The Great Lakes Construction Company has approached the City of Lakewood requesting that they partner with them to facilitate this environmentally friendly project; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that The Great Lakes Construction Company's grant application is due March 2, 2009. Now Therefore, BE IT ORDIANED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That the Director of Public Works is hereby authorized to enter into a Public Private Partnership Agreement with The Great Lakes Construction Company in order to facilitate the replacement of two engines in two Caterpillar bulldozers that will reduce emissions with grant monies awarded by the Ohio Department of Development through its Diesel Emission Reduction Grant program. Section 2. That entering into a Public Private Partnership Agreement with the Great Lakes Construction Company for purposes of passing through grant funds from the Ohio Department of Development, Diesel Emission Reduction Grant Program is in the interest of the public.
