ORDINANCE N0. 29-09 BY: Antonio, sullock, sutler, <br />Dever, Madigan, Powers, Summers. <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law, authorizing the Director of Public <br />Works to enter into a Public Private Partnership Agreement with The Great Lakes <br />Construction Company in order to facilitate the replacement of two engines in two <br />Caterpillar bulldozers that will reduce emissions with grant monies awarded by the Ohio <br />Department of Development, Diesel Emissions Reduction Grant Program. <br />WHEREAS, private companies are eligible for these grant dollars <br />only where they are sponsored by a public entity; and <br />WHEREAS, The Great Lakes Construction Company has approached the City of <br />Lakewood requesting that they partner with them to facilitate this environmentally <br />friendly project; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that The Great <br />Lakes Construction Company's grant application is due March 2, 2009. Now Therefore, <br />BE IT ORDIANED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That the Director of Public Works is hereby authorized to enter into <br />a Public Private Partnership Agreement with The Great Lakes Construction Company in <br />order to facilitate the replacement of two engines in two Caterpillar bulldozers that will <br />reduce emissions with grant monies awarded by the Ohio Department of Development <br />through its Diesel Emission Reduction Grant program. <br />Section 2. That entering into a Public Private Partnership Agreement <br />with the Great Lakes Construction Company for purposes of passing through <br />grant funds from the Ohio Department of Development, Diesel Emission <br />Reduction Grant Program is in the interest of the public. <br />
