Amended on the floor 4/6/09 <br />ORDINANCE N0. ~a-o9 BY: Antonio, Bullock, Butler, Dever, <br />Madigan, Powers,- Summers. <br />AN ORDINANCE to take effect immediately provided it receives the <br />affirmative vote of at least five (5) members elected to Council, otherwise, it <br />shall take effect and be in force after the earliest period allowed by law, <br />authorizing the Mayor or his designee, to enter into an agreement on behalf of <br />the City of Lakewood with the Cities of Bedford Heights, East Cleveland, Euclid, <br />Garfield Heights, Maple Heights, North Olmsted, North Royalton, Parma, Parma <br />Heights, Shaker Heights, Solon, south Euclid, University Heights, Warrensville <br />Heights, the Board of Cuyahoga County Commissioners (Jurisdictions), and the <br />City of Cleveland to reallocate grant funds totaling more than $5,000,000 from <br />the U.S. Department of Justice American Recovery and Reinvestment Act of 2009 <br />Edward Byrne Memorial Justice Assistance Grant (Recovery JAG) as approved by <br />the Bureau of Justice Assistance, and authorizing the City of Lakewood to <br />receive $~f,~0 of those grant funds. <br />WHEREAS, the U.S. Department of Justice has awarded Cleveland over <br />five million dollars; and <br />WHEREAS, Cleveland and the Jurisdictions believe it to be in their best <br />interest to reallocate the Recovery JAG Funds with Cleveland acting as fiscal <br />agent; and <br />WHEREAS, pursuant to the agreement between the Jurisdictions and <br />Cleveland, Lakewood will be reallocated $100,000 for use in accordance with the <br />grant requirements between March 1, 2009 and February 28, 2013; and <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this ordinance is an emergency measure, and that this <br />ordinance shall take effect at the earliest date possible as set forth in ARTICLE <br />III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that expediting the reallocation of these funds will <br />allow the City to begin utilizing the funds for target enforcement within the City <br />of'Lakewood. Now, Therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That the Mayor or his designee, is hereby authorized , to <br />enter into an agreement on behalf of the City of Lakewood with the Cities of <br />
