PLACED ON 1 sr READING & REFERRED TO THE PUBLIC SAFETY COMMITTEE 7/20/09. ORDINANCE NO. 61-09 BY: Antonio, Bullock, Butler, Dever, Madigan, Powers, Summers. AN ORDINANCE to take effect immediately provided it received the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, to authorize the Mayor to enter into an agreement between the Cities Lakewood, Cleveland, Euclid and Cuyahoga County for the interchange of pubic safety marine patrol services in support of the Northern Border Initiative. WHEREAS, the Cities of Lakewood, Cleveland, Euclid and Cuyahoga County (hereinafter "Party Subdivisions' collaboratively staff the Cleveland Public Safety Marine Patrol team in support of the Northern Boarder Initiative; and WHEREAS, Ohio Revised Code §737.04 provides authority for municipalities to contract for the interchange of police services; and WFIEREAS, in order to collaboratively provide police protection and reduce crime, it is the desire of the parties to this agreement to provide for and join in providing for mutual assistance and the interchange of their respective personnel and equipment; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this ordinance shall take effect at the earliest. date possible as set forth ih ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that this agreement is necessary to immediately provide for mutual aid between the Party Subdivisions. Now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That the Mayor be authorized to execute an agreement between the Cities Lakewood, Cleveland, Euclid and Cuyahoga County for the interchange of pubic safety marine patrol services in support of the Northern Border Initiative. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
