PLACED ON 15T READING & REFERRED TO <br />THE HEALTH & HUMAN SERVICES <br />COMMITTEE 10/19/09, 2ND READING, <br />REPORTED OUT ON & RECOMMENDED FOR <br />ADOPTION 11/2/09. <br />-ORDINANCE NO. 77-09 BY; Bulioek, Butler, Devor, <br />Madigan, Powers, Summers <br />AN ORDINANCE to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law, authorizing the Mayor or his <br />designee, for and on behalf of the City of Lakewood to enter into an amended <br />agreement with the Cuyahoga County Board of County Commissioners, Department of <br />Senior & Adult Services, to provide home delivered meals, homemaker services, <br />personal care services, and medical transportation services under the Cuyahoga County <br />Options for Elders Program that will extend the current agreement through June 30, <br />2010. <br />WHEREAS, the Cuyahoga County Board of County Commissioners is <br />administering a program of grants under the Cuyahoga County Options for Elders <br />Program, whereby this City may obtain funds to provide programs for persons 60 years <br />of age or older, and; <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this resolution shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 <br />of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that the signed <br />contract must be submitted to the Cuyahoga County Board of County Commissioners <br />prior to the November 19, 2009 meeting. Now Therefore, <br />BE TT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That the Mayor or his designee, for and on behalf of the City of <br />Lakewood, is hereby authorized and directed to enter into an amended contract with <br />the Cuyahoga County Board of County Commissioners; providing partial funding of the <br />City's Program under Cuyahoga County Options for Elders Program. <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this Ordinance were adopted in an open <br />meeting of this Council, .and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br />
