PLACED ON 15T READING & REFERRED TO THE HEALTH & HUMAN SERVICES COMMITTEE 10/19/09, 2ND READING, REPORTED OUT ON & RECOMMENDED FOR ADOPTION 11/2/09. -ORDINANCE NO. 77-09 BY; Bulioek, Butler, Devor, Madigan, Powers, Summers AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, authorizing the Mayor or his designee, for and on behalf of the City of Lakewood to enter into an amended agreement with the Cuyahoga County Board of County Commissioners, Department of Senior & Adult Services, to provide home delivered meals, homemaker services, personal care services, and medical transportation services under the Cuyahoga County Options for Elders Program that will extend the current agreement through June 30, 2010. WHEREAS, the Cuyahoga County Board of County Commissioners is administering a program of grants under the Cuyahoga County Options for Elders Program, whereby this City may obtain funds to provide programs for persons 60 years of age or older, and; WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that the signed contract must be submitted to the Cuyahoga County Board of County Commissioners prior to the November 19, 2009 meeting. Now Therefore, BE TT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor or his designee, for and on behalf of the City of Lakewood, is hereby authorized and directed to enter into an amended contract with the Cuyahoga County Board of County Commissioners; providing partial funding of the City's Program under Cuyahoga County Options for Elders Program. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, .and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
