PLACED ON 1ST READING & REFERRED TO <br />THE PUBLIC SAFETY COMMITTEE <br />12/6/10, 2t~ READING 12/20/10. <br />(SUBSTITUTED ON THE FLOOR 1/3/11) <br />ORDINANCE N0. 106-10 <br />BY: Bullock, Butler, Juris, <br />Madigan, Nowlin, Powers, <br />Smith. <br />AN ORDINANCE to move Section~.20, Bus Stops; Taxicab Stands of the <br />Codified Ordinances of the City of Lakewood out of the Parking Chapter to Chapter 331, <br />Operation Generally as this section is often cited for a moving violation and should not <br />be a civil parking violation. <br />WHEREAS, in July Council adopted legislation that decriminalized parking within <br />the City of Lakewood; and <br />WHEREAS, as part of that process, certain sections of the former parking chapter <br />were reorganized and moved into Chapter 331, Operation Generally to keep those <br />violations criminal in nature; and <br />WHEREAS, members of the Division of Police have identified Section 351.20, Bus <br />Stops; Taxicab Stands as another section that should remain within the criminal moving <br />violations. Now Therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That section 351.20, Bus Stops; Taxicab Stands, of the Codified <br />Ordinances of the City of Lakewood, currently reading as follows: <br />351.20 BUS STOPS; TAXICAB STANDS. <br />(a) The Director of Public Safety is hereby authorized to establish bus stops and <br />taxicab stands on such public streets in such places and in such number as he shall <br />determine to be of the greatest benefit and convenience to the public. Every bus stop <br />and taxicab stand shall be designated by appropriate signs. <br />(b) No person shall stop, stand or .park a vehicle other than a bus in a bus stop, <br />or other than a taxicab in a taxicab stand when any such stop or stand has been <br />officially designated and appropriately posted, except that the driver of a passenger <br />vehicle may temporarily stop therein for the purpose of and while actually engaged in <br />loading or unloading passengers when such stopping does not interfere with any bus or <br />taxicab waiting to enter or about to enter such zone, and then only for a period not to <br />exceed three minutes, if such stopping is not prohibited therein by posted signs. <br />(c) The operator of a bus shall not stop, stand or park such vehicle upon any <br />street at any place for the purpose of loading or unloading passengers or their baggage <br />
