PLACED ON 1ST READING & REFERRED TO THE PUBLIC <br />WORKS COMMITTEE 2/1/10, 2ND READING 2/16/10. <br />ORDINANCE N0. is-io BY: Antonio, Bullock, Butler, Madigan, <br />Powers, Smith, Summers. <br />AN ORDINANCE to amend Section 905.99, Penalty, of the Codified <br />Ordinances of the City of Lakewood to create a penalty for violation of any park <br />rule promulgated and posted pursuant to Section 905.98, Authority of the <br />Director of Public Works. <br />WHEREAS, Lakewood City Council is simultaneously considering legislation <br />creating a pilot project that would permit leashed dog walking in Lakewood and <br />Kaufman Parks; and <br />WHEREAS, concern has been raised that rules regarding the walking of <br />leashed dogs in the parks or any other posted rule are difficult to enforce without <br />adequate penalties in place. Now, therefore, <br />BE 1T ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That Section 905.99, Penalty, of the Codified Ordinances of <br />the City of Lakewood, currently reading as follows: <br />905.99 PENALTY. <br />(a) Whoever violates Sections 905.01 through 905.18 (with the exception of <br />Section 905.07(b)), or fails to comply with the requirements thereof, shall be fined not <br />more than one hundred dollars ($100.00) for a first offense. For a second or <br />subsequent offense, such person shall be fined not more than one hundred dollars <br />($100.00) or imprisoned for not more than sixty days, or both. <br />(b) Whoever violates Sections 905.07(b) or 905.19 shall be fined not less than <br />five dollars ($5.00) nor more than twenty-five dollars ($25.00). <br />shall be and is hereby amended to read as follows: <br />905.99 PENALTY. <br />Whoever violates any provision of this Chapter, or fails to comply with any <br />Rule established and posted pursuant to Section 905.98, Authority of the <br />Director of Public Works shall be guilty of a minor misdemeanor. Anyone <br />found guilty of committing a second or subsequent offense within a twelve <br />(12) month period shall be guilty of a misdemeanor of the fourth degree. <br />
