(Placed on 1~ Reading & Referred <br />3/1/10, placed on 2"d Reading 3/15/10, and Deferred 4/19/10.) <br />Amended on the floor 5/17/10. <br />Ordinance No.: 23-10 By: Antonio, Bullock, Butler, Madigan, <br />Powers, Smith, Summers <br />An Ordinance to enact a new Chapter 309, Parking Violations Bureau, within the <br />Codified Ordinances of the City of Lakewood for the purpose of decriminalizing parking <br />citations pursuant to the authority granted to municipalities in Ohio Revised Code <br />Chapter 4521. <br />Whereas, in an effort to make parking violation collections more efficient, the <br />City of Lakewood would like to decriminalize parking violations to allow the City to take <br />part in the Ohio Bureau of Motor Vehicles Drivers with Excessive Tickets Excluded from <br />Registration (D.E.T.E.R.) system of reporting violations; and <br />Whereas, participating in the D.E,T.E.R. system of reporting a places an <br />automatic block on an individual's registration of a vehicle in the event that they have <br />(1) unpaid violation for parking in a handicapped parking space or three (3) unpaid <br />parking violations. Now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That Chapter 309, Parking Violations Bureau, of the Codified <br />Ordinances of the City of Lakewood, is hereby enacted to read as follows: <br />309.01. Definitions <br />The following words and phrases, when used in this Chapter of the Traffic Code, <br />shall have the meanings respectively ascribed to them by this Section. <br />(A) "Parking Infraction" means a violation of Chapter 351 of this Code. <br />(B) "Vehicles" has the same meaning as in RC. Section 4511.01. <br />(C) "Parking Violations Bureau" means the Parking Violations Bureau <br />established by the City Council of the City of Lakewood pursuant to 309.02 of this Code. <br />(D) "Notification of Infraction" means the notice mailed to the owner or <br />operator of a vehicle involved in a Parking Infraction pursuant to Section 309.05 of this <br />Code. <br />(E) "Court" or "Municipal Court" means the Lakewood Municipal Court. <br />
